About Us

Hickory Hill Community Association

The mission of the Hickory Hill Community Association is to enhance the livability of our neighborhood, to protect property values by monitoring and enforcing our restrictive covenants, and to effectively and efficiently utilize membership dues to the benefit of all association members.

About our association

Hickory Hill Community Association, Inc. was first incorporated on January 25, 1993, and was originally plated and developed by Schenkel-Shultz through the Allen County Plan Commission.

The subdivision contains 103 lots, with a single family home built on each lot.

Effective December 31, 2001, the subdivision was annexed by the City of Fort Wayne, and falls within Council District 3. Our current Council Representative is Tom Didier.

The subdivision is served by Fort Wayne Community Schools.

Association dues are $115 per year.

 

Protective Restrictions, Covenants, and Limitations

Following is a summary of some of the language contained within our restrictive covenants:

Property rights - Each owner (1 per lot) is a member of the association. Each owner has 1 vote in the association. Each owner has the right to enjoy the Common Area.

Association dues can only be raised by a maximum of 8% per year unless a majority of owners elect to raise association dues by voting for an increase. Each owner is required to pay the annual dues assessment. The Association has the right to place a lien against any owner who fails to pay the annual dues. Further, the Association is entitled to recover attorney fees, costs, and expenses incurred due to the failure of an owner to timely pay assessments.

Special assessments for capital improvements can be levied but only after at least 51% of the association membership approves such action.

The Association has rights and responsibilities regarding architectural control, and has authority to review all construction, modifications, and additions of structures in the subdivion. "No building, fence, wall, in-ground swimming pool, or other structure shall be commenced ...nor shall any exterior addition, change, or alteration be made to a structure until the plans and specifications ...are submitted to and approved" by the Architectural Committee. The Architectural Committee is directed to review requests to insure harmony of external design and location in relation to surrounding structures and topography in the subdivision.

Minimum home size is 1450 square feet.

No driveway access shall be allowed from Lots 95, 96, and 97 onto the Wallen Road right of way.

It is the responsibility of each lot owner to install a post type yard light in front of each residence. The light shall be hard wired to the house panel and shall operate on a photo cell.

Overhead wires, poles, or overhead facilities of any kind for electrical, telephone or television service are prohibited.

Surface drainage easements were established for drainage purposes on the Plat. Drainage easements shall be maintained in an unobstructed condition, and the public authority having jurisdiction over storm drainage shall have the right to determine if any obstruction exists, and to repair and maintian, or require such repair and maintenance, as shall reasonably necessary to keep the conductors unobstructed.

No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done there which may be or become an annoyance or nuisance to residents in the subdivision.

No structure of a temporary character, trailer, boat trailer, camper or camping trailer, tent, shack, garage, barn or other outbuilding shall be constructed, erected, or located on any lot, either temporarily or permanently.

No boat, boat trailer, recreational vehicle, motor home, truck over 1 ton, or camper shall be permitted to be parked ungaraged on a lot for periods in excess of 48 hours, or for a period of which in the aggregate is in excess of 8 days per calendar year.

No poles, clothelines, or other free-standing poles, rigs, or devices are permitted except for 1 pole supported bird feeder or bird house per lot.

The Association has the right to enforce, by any proceeding at law, all restrictions, conditions, covenants, reservations, liens and charges imposed by the provision of the covenants. Failure by the Association to enforce any provisions shall in no event be deemed a waiver of the right to do so later.
