So there has been some discussion between a Homeowner and the Board of Highline Meadows.  The discussion is about Denise/TMMC's termination/resignation from various communities around the Denver area.  The Board doesn't seem to know, or believe, that Denise/TMMC has been or would be fired as HOA manager.

A little history.  Second Jefferson Green in Lakewood fired TMMC when they realized the poor managment they were receiving from TMMC.  Cherry Creek Farm, while sharing information with the Highline Meadows Reclamation Project, organized removing and replacing three (3) Board members who were supporters of TMMC, whereupon Denise/TMMC resigned.  The most recent was
The Cay at Marina Pointe, who organized with the Highline
Meadows Reclamation Project, and removed their entire Board,
who were TMMC supporters, whereupon Denise/TMMC
immediately resigned.

We need Justice.  We have no Vote.  We did note select the managment company TMMC or the Board of Directors.  The Board will not answer where the money is!

 

Our property values have fallen over 65% and Highline Meadows is falling apart as we continue to pay special assessments and high HOA dues.

 

The paint and porches are cracking and chiping as the Board of Directors ignore the paint for ten years and spend all the money on Landscaping, pool and clubhouse.

 

We are the poster children for HOA's gone "A Muck" as we are being taken to the cleaners with wool over our eyes and we cant do anything about it.

We need the Board of Directors to provide “ Full Disclosure” of the Actual HOA Monies being used in each category. Details of this “Full Disclosure” would include where, when and how the monies were used for such things as;

 

Common Area Maintenance, Drywall, Plumbing, HVAC, Paint, Misc Maintenance, Electric at Clubhouse, Pump Lift Station, Pool, Clubhouse expenses, Laundry Room expenses, Cell Phone, gas, Snow removal, Exterminator, Carpet and floor, Lights, Security and Exit, Parking lot, Balconies, Landscaping, Pond, Tree trim, Fence, Lawyer cost, Maintenance Man hourly wage and management TMMC company Cost and Profit.

 

It is up to the Board of Directors to provide us with the Insurance details and information regarding coverage, for such things as, water main back-ups, lift station pump failures, Roof Leaks, Drywall (Asbestos) and HVAC Boiler replacements in the Condo buildings.

 

So far, my request to TMMC and the Board to get this information has gone on deaf ears.


 

 

Even our 70K maintenance person Rory can Do most of the plumbing work and rent a snake from a local facility and do it. But we would rather spend it on him and third party contractors. :Like  a huge Business!!  And when the buildings need paint..........Like everything around here ....they don't have the money because they already spent it, therefore nothing will be done "like always".  Only a "special assessment" will bring in the monies because that would affect there "set budget" which is on "auto pilot" to deduct the cash from our accounts and assure that we have "nothing left" at the end of the year "just like the last 12 Years".

 

Highline Meadows has always been Highline Ghettos because of this....

 

The only way out of our delima is a "Class Action Lawsuit".

  • Breach of Contract
  • Tort - Breach of Fiduciary Duty
  • Injunction, Declaratory Action, or Damages

 

The ongoing, presented  "lies of our money being used" in the Budget should be stopped. The "books are crooked" and don't make sense. Modified Accural Accounting ????

 

We have presented the questions and have no answers. "How can you bring in 1.5 Million Dollars at the beginning of Jan 2011 and put it all in the 2011  budget.  Then show an accounts receivable of 1.2 million. Why was none of these monies ever shown used in the month of Jan 2011. Where did the money go? Over $$$$$$$$$200K????????????????????????????????

 

This is why we cant trust these people with our money and need serious help. To make matters worse this is just one small example of how the "books don't make sense" and the "monies are floating all over with no control or accountability".

 

You cant make "heads or tails" out of the Budget and the Monies. Therefore,  you can trust TMMC who writes the books, or the Board who signs the checks TMMC writes. All these people should step down due to there incompetence.

 

Its going to be business as usual, because the Board "trusts Denise and TMMC with the books" and they really do not have a clue where the monies are really going.  It's all a big business and we "all suffer for it" as the board pats themselves on the back,  and did institute another "1.5 million dollar assessment" in November and wait for the bennies to roll in.

  

So, are we really "suing ourselves" with a class action lawsuit.  The answer is "NO" because we "don't have any vote" or say in "way our monies are currently being used", or "how  the budget  is written" or special assessments imposed.

  

Therefore, in order for this community to gain control of this total neglect of responsibility, and to assure property values are maintained.  The complex needs to run more efficiently, cost effective and in a 1st class order.

  

The only answer is to "take the Board of Directors and TMMC to court and let the Judge decide".  If we do not do this we will remain on the same path with "no say" in our property as we will continue paying outrageous dues and special assessments which would only show small change (Capitol Repair) over a long period of time (5 years).

  

Attending the meetings will not stop this board because we cant reach "Quorum" as a community. To make matters worse, they will not answer the questions and have "lied to this community" and have a "hidden agenda" that they are not sharing.

  

We are being "held by this dictatorship" who we did vote for and they are taking advantage of us as "Poor Sheep in a Field" ......all the way to the bank. It's business as usual and "you cant change it".

 

The accounts Receivables has been as high as 325K after the 2008 special Assessment, we have always had very high A/R over 200K since special assessments of 2007. As a matter of fact look at the graph above and see that it barely moved in 2010 while our cash on hand was in the negative!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

In Reference to the Insurance. Good luck trying to see what is covered in this policy since I have asked for the information (TMMC Denise and Peliton Insurance) a half dozen times and gotten nothing.

 

As far as the budget, there is always a run on the monies at the end of the year as we seem to be left with nothing for the new year.

 

Your absolutely right there is something wrong!

 

I wish more people would question their outrageous spending and inflated budget.

 

Until these board of directors pick up a calculator and learn to add and subtract and really see where the money is going, we are in for more of the same with TMMC at the wheel.

 

A huge business and money squandering operation here at Highline Meadows.

 

TMMC writes the budget and the Board signs off on it. No questions asked........ No Vote taken on spending or Budget. Leave it up to them and we will always be broke with nothing but leaking roofs.

 

  

So, its business as usual as this "money sucking machine known as TMMC and the Board" drain our monies each years and we as a community slide into possible Condemnation.

  

You would think that the Government could step in.......Nope sorry , I already has discussion with Senator Linda Newell. Its all in our hands as homeowners in a HOA out of control.

  

Even a small group of owners can issue a class action lawsuit.

  

If this is not done we don't have a chance or any hope left.

I wish I could find good and praise for the current Board and our situation , but it is clear that they are not using the monies correctly,  and have severe accounting flaws and accountability of the monies.

 

You may enjoy seeing your properties get sub par landscaping improvements, which may shift your opinion of the situation, but lets face it,  "we need some serious change" to get things back into order here at Highline Meadows. 



"It is high time for change in the management company TMMC.  We need new and better people at that level.

 

Please tell me what is good about Denise ,TMMC, the way the money has been used,  and the accountability of this association in their promise to the good members who's house value has drifted out to sea.  I really don't care about the price or value of my home, I am only interested in Truth.... “Honestly and using the monies correctly” and most important.... accountability.

 

Over the years,  I have proved that the monies are not being used and reported correctly, that there are missing monies and that official financial documents have changed.   It seems as if it is nothing more than a big business for this association, and TMMC, as they use all our monies each year with no accountability.

 

As a owner,  I want to see where the money is exactly being used and why!



I and others want accountability. We want them to answer the question of where the monies have been used. No general explanations.. but yes........DETAILS.. And please.... don't tell me that I can see the books. I want them to answer the questions!

 

I don't trust TMMC, Denise or her records based on my analysis and find based on the continued demolishing structures that are not being up kept like... paint, carpet ,porches, roofs and mansards. We could have a serious accident from a porch failing while you keep the clubhouse and pool pretty.



This property has been ran into the ground by TMMC for nothing more than profit,  which in the end,  was never meant for the paying association members,  but as a profit making business for the management company.

 

The board members are nothing more that followers of Denise and TMMC and can't think for themselves and also cant bring themselves to look over what I have found. Thats right the facts!

 

They are being brainwashed into believing that TMMC is doing such a great job while ignoring the facts. This is shameful.

 

Wake up and see the big picture!  Debunk my findings if you can.    I would nothing more that praise the Board and the Management company, but based on proven facts, which is there information supplied to the owners,  we have been "taken to the cleaners" .  As owner here at Highline Meadows,  and it is high time for change.....desperate change. Now.........

 

If we continue with TMMC and the current board we will remain on the same course of falling property values, overspending and deepening corrosion of the structures here at highline meadows.

 

How can the landscaping, pool and clubhouse be more important than the porches, paint, and interior of the buildings?

 

You really need to look at the work I have done and the research and really look at it.    After that I am very sure that you will see exactly what is going on here at Highline Meadows.

The whole reason the D.O.R.A. complaint system was started was to be used for statistics on H.O.A. and property management issues for possible future legislation, not punishment, Yet... Suing is an option for an almost zero percent success rate.

 

 Due to fact that H.O.A. board members are volunteers and can't be held liable or personally accountable for H.O.A. related issues. Management companies oversee alot of the maintence and chose the contractors that do the work and that can lead to corruption and biased decisions to line ones pockets for big contracts or a volume of contracts. Pay to play if you will.

 

Most H.O.A.'s are ill informed when it comes to making hypothetical decisions about maintance or construction and usually reley on management companies for a one stop shop for solutions and their own lack of incompetence. I have posted another post ealier if you care to read that explains this situation in detail. Yes, I agree most people don't show up to meetings is a problem for proxy's but, on the other hand makes it a skatewalk when management companies and H.O.A.'s make decisions and bylaws in their favor on peoples hard earned money.

 

People pay their dues and trust that things are going to be taken care of are very naive until something happens to them personally from the lack of action you get from a property management companies or H.O.A.'s. Then they get involved and realize what they have been paying into isn't really what they thought or expected the solutions to be. Most people who buy into townhome or condo's with H.O.A.'s are young busy professionals who don't want the duty or have the time for a yard or exterior maintence.

 

When you have management companies making decisions on real property with millions of dollars a year at stake and no oversight there is going to be problems period. Regulate property managment companies like real estate agents and make annual classes available for management companies mandatory and H.O.A. board members if they are not qualified or need skills sharpened so people can be more informed.

 

Making decisions on real estate is a very serious issue when unskilled people are running or mismanaging them. There is neighborhood stability, equity, and private properties on the line. A Mcdonalds resturant has more regulation than a property managment company seriously. Martinezs' journalism degree took alot more than your property managment degree. Oh, wait you don't have to have one. There would be alot more complints to DORA but it based per household being 1 and even though 6 people may be living there and also alot of people don't know about this recording of complaints process yet. Including you, you claim no company has been investigated. Well of course not there is no regulation on management companies, duhhh.

 

Like I already said it is for informational purposes only, it states that right on the first page you probably failed to read yourself what the mission of the information was to be used for. Hopefully they read this and a few other post and that number will change drastically to 10 fold, you know it and I know it. People if you live in a H.O.A. and have a problem go to the website
