The Association (I omit the term "Homeowners" because their first priority is to represent themselves)recently settled a law suit that they had filed against one of our neighbors. I am aware of the details of this obsurdity because the family that was sued are dear friends of ours. Many of you may already know the family or may be familiar with certain aspects of this case. My own interest in the case is primarily centered around the abuse of power exhibited by the Association and the misuse of funds to launch such a frivolous suit against these long- time residents of this fine community. The details are quite lengthy and I'd be happy to comment on the particulars in a later post, but for now, the important points are these: (1) The family submitted all of the required information and paperwork to construct an addition to their home (12'X 12'). After receiving no response from the board for almost 2 months, construction began on the new room. (2) When the neighborhood "trash can police" (John Herbert of Rossmar Mngt) saw that the project was underway, he insisted that it be torn down because it was never approved. When asked why it was not approved, the family received several excerpts from the CC&R's that had no relevence to the project whatsoever. (3)Knowing that they were in full compliance with both the CC&R's and the architectural guidelines, the family finished the project (which, by the way, is a beautiful addition). (4) The Association spent Thousands of dollars of our money (yours and mine)on this pitiful case. After milking this suit for all that they could, the attorneys for the Association then advised the board to settle (knowing all along that if the members of the board were dumb enough to think that they could win the case then, hey, why not make a little money off of their stupidity). God, don't you just love lawyers?!

I also know about this case and you couldn't be more wrong than you narrow one sided view.

Unauthorized Home Addition

It sounds like your one of those people that sounds off without knowing the facts! If you were not involved in the court case, how do you know exactly what went on, other than a one sided view point? I heard that both sides spent thousands of $$$ in legal costs. Everyone loses, including you and I. If the HOA let everyone build, contrary to arch. guidelines, this neighborhood would be a mess. Some would look good and others would degrade the value of our homes. I applaud the Board for wanting to keep the neighborhood values up. Your one of those people who spout off but won't get involved in any means to keep the community looking good. For years the Board is looking for members and subcommitte members, but it seems that none of us have the time to help, including me. But at least I'm not running off at the mouth or putting down the Board who tries to do their best and volunteer many hours of their time for our community. If you can't get involved and try to make things better, you have no right criticizing unless you get involved. I've attended a few board meetings and spoke to these folks, who I found out later, is one of my neighbors who is well liked in the community. Can you say that about yourself? I apologize to my other good neighbors who have to read my sassy note, but I get very upset when people sit back and criticize and won't get involved. To all my other neighbors, have a great day.

How about some details then?

So you know about this case do you "Ann"? Perhaps you'd like to elaborate on the details as you see them rather than simply posting a half-witted response like "your wrong". My information comes straight from the family involved. Where do you get your information? I've talked to the majority of the neighbors living within view of this home and every single one of them agrees with me. You obviously have some sort of ties to the association and if that's the case then I pitty you.
