It looks as though you have spent an lot of time on this issue and are quite invested in it. But in your writing you have never recognized that there are some of us out there trying to enforce the deed restrictions and your comments become offensive to our dilligent efforts. No, we may not be the most effective bunch but we are at least making an effort.

Lawsuit Stats



I went to the county court house to see just how many lawsuits the Association has filed. Below are the number of lawsuits by year. This is proof that the Association is NOT doing its job!

One reason for the low number of lawsuits is that they are ineffective. If a homeowner refuses to pay court cost and attorney fees then there is not much the Association can do. Also the homeowner can refuse to correct the deed violation. In this case the Association has to spend more money getting an injunction. The government is not going to spend taxpayer money locking people up for violating deed restrictions.




With foreclosure the Association will be able to strictly enforce the deed restrictions. Foreclosure shifts the cost from the Association to the homeowner. Foreclosure will make deed enforcement ''meat-head proof''.

Foreclosure is Unnecessary

Foreclosure is an extremely punitive action for someone not mowing their yard or for painting their house an unpopular color. Imagine, taking away someone's home, making them homeless and causing them to lose the equity they have built up in their home for some ridiculous offense. And, take into consideration that many times deed restrictions are used against someone that the neighbors just don't like because of their race, religion, or the fact that they ''just don't fit in.''

An unmowed yard is annoying, as is peeling paint, but working with people, as the Sharpstown Civic Association does, to remedy problems is more conducive to a pleasant neighborhood atmosphere than the carpet-bombing approach you suggest with foreclosure. That law is there to protect us from people like you.

Quite frankly, you have TOO much time on your hands that could be put to more productive use.
