The staff of the Planning Commission has issued its ''findings'' concerning the Fenley development called The Midlands. This is the property along the Watterson and behind the Dairy Queen on Highway 22.

Here are selected comments from the staff report ....

Staff Findings

1. Staff finds that the land use is appropriate for the site, and that the rezoning is consistent with the Comprehensive Plan (guidelines noted below).

2. Staff finds that the proposed screening and buffering of the site from the single-family residential to the east meets applicable codes, and that the applicant has provided the interior sidewalk as requested.

2. Staff finds that a rendering is needed to evaluate the appearance of the structure.

3. Staff finds that this development is not an over-development of the property, and that the requested waivers and variances are justified by existing topographical conditions.

Relationship to Comprehensive Plan - Cornerstone 2020 Plan Elements:

Community Form: This site is in the Neighborhood form district, which permits non-residential uses that are located at the intersection of two major streets, and which are small scale, neighborhood-serving uses. The applicant is requesting a form district change to Town Center, presumably to permit C-1 uses within this Planned Development.

The land use proposed is consistent with the Town Center Form District, and this site is located immediately adjacent to an existing Town Center form district. Therefore this form district change would be essentially an expansion of an existing Town Center.
