It might be stealing, it might be sloppy record-keeping, it might be foot-dragging hostility. My gut tells me that it would depend on the type of documents. Some might be considered work product; others, the property of the HOA. Depending on what type of organization you have, a letter from your Association's attorney might show you're serious.
You also might need to revamp your process during good times (i.e., collect relevant documents at board meetings and store them in a neutral location or create a redundant system) so that you don't have this problem when things go wonky. You might also consider hiring a small management company and make sure you insert a provision that all documents they store for you are the property of the HOA and will be returned when a contract ends for whatever reason. |

No, I actually consider it theft, because the records were repeatedly asked for by many different people. Unfortunately this situation has gone on for so long that the two people who are refusing to give up the records have in effect frozen the other elected officers into a state of impotence. Sad to say that each day the remaining elected officers sit around on their keisters and do nothing makes the two more powerful and the rest look like ‘weak sisters’. When this situation came up I was being very vocal from the get-go. The others looked at me like I was getting all excited and that the two would come to reason, ha! The vindictive have no reason nor remorse they are in it for the long haul to be disruptive and cause exactly what has happened, the immobility of the Organization. I now really just don’t care any longer. The powers-that-be don’t care so why should I any longer.
The saddest thing about all this is that one of the two was instrumental in my eventual participation in this organization in the first place after years of ‘nagging’ about me getting involved. The other, I actually went to high school with and knew better than get involved. My concern is now behind me. I have said my piece and peace, it is up to those that should have done something in the first place to do something now.
