Below is the letter Brenda Hatch submitted to the Board of Health to justify a hardship in order to receive a variance on her septic system at 30828 Isenberg Lane. You decide.

August 6, 2007

Craig Sanders
Environmental Program Supervisor
Jefferson County Department of Health and Environment

Mr. Sanders;

Thank you for your careful review of my request for a variance. You have asked for supplemental information about my personal hardship.

My personal hardship is as a single mother with a child in Evergreen High School, I will need to down size my older home to a more efficient, more affordable home. My son has always gone to school in Evergreen, with the exception of one year we moved away. The result of moving away was so difficult for him to adjust that we moved back to Evergreen.

When 30828 Isenberg came to my attention, I was aware of few details of the property. I knew that a half acre at 29684 Lee Road, in our neighborhood was granted a variance for a septic and that the Isenberg lot is 33% larger. I had thought when purchasing my lot that I could purchase some property from Cheryl Peterson who owns fourteen acres including a strip between my lot and the private portion of Isenberg Lane. I did not know the County would prohibit us from completing our agreement until my lot was deemed buildable.

The consequences of the Board denying the variance requested, will prevent me from building a more efficient, more affordable home on Isenberg, in an area where I have lived for more than 21 years. The consequences of the Board denial may lead to me having to move away from Evergreen. Not being allowed to build on Isenberg may lead to my son choosing to live with his father, to finish his school. I could actually be denied the luxury of raising my son to adulthood.

I ask that in consideration of the lot being platted prior to 1972, the fact that there is no land to add to my lot, that the lot can meet separation required by the County and the personal reasons mentioned in the above, that you please grant a variance for my lot at 30828 Isenberg Lane. Thank you again.

Sincerely, Brenda Hatch.
