I have contacted an attorney to discuss opportunity for legal action against the firm managing the HOA for Decatur Commons in Decatur Township, Indianapolis, IN.
I have had multiple calls to the Decatur Commons HOA firm with none of my calls being returned.
My discussion with the attorney will be focused on obtaining full and complete HOA dues paid for 2024 given the HOA firm's negligence in providing snow removal of the streets in Decatur Commons. I have videos on my cell phone contrasting the obvious difference in the snow removal which was done for Decatur Ridge by their HOA and what was not done by the HOA for Decatur Commons.
How do we schedule a meeting of the home owners in Decatur Commons to enlist their involvement in this effort to recover HOA fees?
It is obious to any observer there was snow removal of the streets in Decatur Ridge while there has been zero snow removal for the streets in Decatur Commons. It is very apparent as of today, 1/8/2025, (with the abundant sunshine) how quickly the snow melted from the streets in Decatur Ridge while there is little (if any) melting of snow from the Decatur Commons streets. Again, it is obvious there was no snow removal following the snow of Sunday, 1/5/25. I have videos showing the streets of Decatur Ridge and the streets of Decatur Township which will be provided to the attorney to support our request of HOA fee refunds.
My objective in working with an attorney on this issue is to recover my homeowner association fees as well as any impacted Decatur Commons residents. It is my intent to charge the responsible company with negligence and dereliction of duty to meet their responsibilities of snow removal associated with the homeowner fees.
