Pre annexation Agreement posting

Much has been posted and opinions given relative to pre annexation agreements. This issue has been mentioned for some time within newspaper articles about annexations and court cases that continue to brew over the current issues. Many of the previous writings do not include the texts of the deals in question.

In a manner of being as open and forthright as possible and allowing the public to make their own determinations I have requested the PATA webmaster to post one of the complete pre annexation agreement texts. On the ?“Our Pages?” section of this web site is one of the most recent pre annexation issues involving the SCC and the City of Pickerington. This agreement is a matter of public record, as are all the other pre annexation agreements. For someone to begin to understand the annexation issues that abound, it is important to have access to the facts related to the issues. The usage, and language, of pre annexation agreements is part of these important facts.

It is important to note that not all municipalities use pre annexation agreements and locally there is a great deal of different contractual obligations within the texts of the various pre annexation agreements that the City of Pickerington has offered.

Do you know what ''Councilmatic'' means in the pre-annexation agreement that you posted on the Our Pages section of your site? I see this used to promise a zoning class or use in this agreement, is this legal in your opinion?I have notice this word used in other city legislation in the past year or so. Is this some sort of guarentee to the parties involved cementing these promises in a contractual way?

Between Markie Marks posting of the Pastor?’s words ( Once the land sells, which is tied contractually to the annexation, ) and the pre-annexation agreement Picktown SCC pg 2. Contemporaneously with annexation, the City will rezone up to one half the property to PR-10 zoning designation.... The City agrees to cooperate with Sycamore to enhance the development of the condominiums under the PR?–10 plan.
Sure reads like contract zoning, doesn?’t it!

And it appears to be at PR-10, a higher density zoning.

If the zoning density is contractually arranged between a Pastor and a City Manager what have we got here?

Councilmatic

My observations of ''Councilmatic'' are issues, Ordinances, Resolutions, etc. which do not go through any sub-committees (Service, Safety, Finance) of the Pickerington City Council. As they do not go before the subcommittees there is very little interaction (public & elected officials - oop's I forgot this is Pickerington, where there is very little public knowledge presented in advance of any meeting)before a vote.

''Councilmatic'' in reality means ''done deal''.
