Is Council guilty of ELECTION FALSIFICATION (emphasis added)?
In Law Director, Bob Mapes?’s, April 2nd position paper on 3 previous initiatives Mr. Mapes railed on and on about ?“Election Falsification?”. He repeatedly pointed out that this is a FELONY OF THE FIFTH DEGREE (emphasis added) and this was stated over and over again in the local media. Each of these (emphasis-added) points are exactly how Mr. Mapes presented them.
Mr. Mapes?’s paper then concludes ?“the city is bound by our Charter to follow state law on the initiative and referendum process.?”
So Mr. Mapes you now find yourself and this Council in a mandamus action before the Ohio Supreme Court on the issue of a properly presented Charter Amendment, on the correct form, with the correct # of verified signatures. This Council refused to pass this issue on to the Board of Elections as required by state law.
Again the question, are you and this Council guilty of a fifth degree felony?
