Decision to grant zone change.


The city's Hearings Officer has made a decision about the application of EJS Properties to rezone their site at 1636 and 1616 SE 39th from R5 to CN-2.

The decision is to grant the zone change, with the following conditions:

1. Development on this site is limited to residential of 45 dwelling units or less.

2. Development on this site may not occur until proof that a restrictive
covenant has been placed in the Multnomah County Deed records containing the legal description of the site and the following language, or other language accomplishing the same purpose which is approved by the City Attorney or OPDR:

"This property was subject to a land use decision by the City of
Portland (LUR 99-01022 ZC) which changed the underlying zone to CN2 but limited the use of the site to a 45 unit or less multi family development. Commercial uses were specifically prohibited under this decision."

Interested parties (who have already expressed their concerns, by letter or in person), can appeal the decision to the City Council before June 28th.

Cost to appeal is $1317.00. If no one appeals, the zone change is effective on June 28.

After that date, the applicant could submit plans to the city for a building permit. He also may choose to apply for adjustments to the standards that would apply, in which case neighbors and the RNA would receive notice of that.

Cedarhurst Apts Appeal Hearing

Cedarhurst Apartments Appeal Hearing. (Notice received July 25.)

Three people concerned with the proposed Cedarhurst apartments at 1616 SE 39th have appealed the Hearings Officer's decision to grant a zone change from R-5 to CN-2 for the project site. The one house on the site was recently removed.

Lois Wakelin, James Bohen and Phillip Moran appealed the decision, stating that ''The proposal does not meet the approval criteria related to transportation needs and traffic impact. The Traffic Impact Study requires further analysis based on the development proposal submitted.''

The hearing (originally scheduled for August 2), has been rescheduled to August 30, at 2:00 PM, before City Council. Only issues raised previously can be brought up. For more information, contact Ellen M. Wax, the Land Use reviewer at the city, at 823-7836.

The Richmond Neighborhood Association voted to take no position on theoriginal zone change application, and therefor will probably not be a participant in this hearing.

Land Use Meeting 9/7/00

Doug Klotz asked me to forward this message to all of you. Land use meeting to discuss apartments on SE 39th. A meeting is scheduled for Thursday, September 7th, at 7 PM at Southeast Uplift, in the upstairs conference room, at 3534 SE Main, to discuss the proposed apartment building on SE 39th at Market. The developer, Everett Smyth, will be there with his design team to discuss and sketch possible design changes.

The results of this meeting will be presented at the Richmond Neighborhood Association meeting on Monday September 11, at 7 pm at Central Christian Church at 1844 SE 39th.
