Deed Of Restrictions (partial)

This development is governed by a Deed of Restrictions. A partial list is shown below. For full list please consult the settlement package you received from your attorney. They are required BY LAW to provide a copy of these when you settled. However, you can also get a copy by emailing the neighborhood contact (link at left).

Deed Of Restrictions

Red House Plantation is a Deed Restricted Community.

By abiding by the Deed of Restrictions,
you can be assured this will continue to be a desirable neighborhood to live in and the homes will continue to increase in value.

The following is a quick reference guide to the restrictions. If you do not have a copy of the entire document please send us an e-mail so we can get one to you. Remember, if you plan on doing anything to your house or property that differs from the original appearance please submit your plans to the Association for approval. Also, if you see something against the Deed Restrictions that should be addressed or if you have any questions please let us know.


EXTERIOR APPEARANCE (Article IV)

  • Each owner agrees to maintain the exterior appearance of the structures on his lot including the dwelling and garage in a condition as similar to the home when it was purchased.

ARCHITECTURAL CONTROL (Article III)

  • No building, fence, wall or other structure, as built, shall be altered, extended, added to or modified in any way. Examples: color changes or the addition of basketball hoops. Before doing, plans indicating the nature, kind, appearance, materials and location of work need to be submitted to the Association (or the Association's Architectural Committee) and approved by the Association.
  • The correct colors are Chestnut Brown and Colonial Blue.

USE OF PROPERTY (Article V)

  • The lots are residential use for use by one family (paragraph 14).
  • The only pets permitted are "common domestic" (not exotic) pets and are limited to two, kept inside. (Paragraph 16)
  • Garbage and rubbish need to be kept in closed containers and out of site (or in garage) except for the day of pickup when it can be placed by the street. (Paragraph 18)
  • No trailer, travel trailer, mobile home, tent, shed, shack, garage or other outbuilding are allowed (paragraph 19)
  • No boats, aircraft, trailers (boat, hauling, etc.), mobile homes, commercial vans, tractors, buses can be parked in the community. Operational automobiles and pick-up trucks are permitted on the roadways and parking spaces for up to twenty-four hours, but no longer than that. (Paragraph 20).
  • Laundry lines and poles outside houses are prohibited. (Paragraph 21)
  • All lawns and shrubs need to be kept in a neat and presentable condition. (Paragraph 22)
  • No radio, TV, communications towers, aerials, "dishes" or other transmitters or receivers are permitted. Note: the FCC requires that Direct Broadcast Satellite (DBS) receivers are permitted, but the Association requests that if installed, they be located in a location that is as far away from street view as is practical and still receive a good signal. Rooftop mounting (on the back side of the house if possible) is recommended.
  • Christmas lights are permitted but not before December 1st and must be removed no later than January 15th. (Paragraph 23)
  • Owners may perform reasonable landscaping, as they desire. (If you have any questions about what is reasonable, you can submit your plan to Association for a ruling.)

In 1991, the Deed of Restrictions was modified in the following ways:

  • Owners may erect a fence in the rear yard (not front or side), but it must be a three-rail split-rail fence of spruce or hemlock rails and locust posts (see addendum document for specific details for fence design and construction).
  • - The bottom of the rear deck area can be wrapped with pressure-treated lattice work to create storage under the deck.
  • Owners may install a storm door/screen door, but the door needs to be a "full light white storm and screen door."

2002 Annual Dues:

The annual assessment of $100.00 was due by February 1st of this year.
(There is a $20.00 late fee if not paid by February 1st.)

We need the funds for the upkeep of the community for grass cutting, snow plowing, liability insurance, etc.

Other news items

Parking:






 
Please try to refrain from parking in the streets. If possible use the available additional parking lots. If you must park in the street, please do not park in the grass.

Also, no boats, trailers (boat, hauling, etc.), mobile homes, commercial vans, tractors, buses can be parked in the community. Operational automobiles and pick-up trucks are permitted on the roadways and parking spaces for up to twenty-four hours, but no longer than that. (Paragraph 20 of the Deed Restrictions).


Mailboxes:

If you every have have difficulties with your particular mailbox, please call the postal service at 302-737-5770. The maintenance crew works every Tuesday and Thursday.


Street Lights:

The two street lights that were out have been fixed. If you notice a street light that that needs repair near your house, please call Conectiv at 454-0300 and press "0" to speak with a representative. They just need a description of where the light is (the number of the house closest to it). You can also give them a pole number if you have it.
