You can find these rules in Article V.
Board of Directors has limits when preparing a yearly budget. The yearly budget is based on the previous years lawfully approved expenses + 10%, if needed, with a maximum of $120.00 per lot, per year. There is a difference between a approved expense and a lawfully approved expense. That being you might have bought something the previous year and had the members approval. With that said it would be a lawfully approved expense the previous year, but not in this years budget, unless it is a carry over expense. The Board of Directors don't need the members approval if the budget is under $120.00 per lot and not over 10% from the previous year approved budget.

The 2009 Budget/Assessment was over $120.00 per lot, without the members approval. The members were not asked for approval. In facts, there was over $56,000.00 worth of non-approved items in the 2009 budget. Items that the members were not asked to approve.

Our Board of Directors hired more professional management, again without the members approval. What for, they just volunteered to manage the association June 18, 2008? $35,700.00 for a non-approved item.

This association is being mismanaged in a illegal way that is costing the members thousands of dollars each year. It is up to the members to stop this mismanagement. It is up to the members to investigate our association for wrong doing. Maybe we need to do a membership head count to find out who don't mind paying for non-approved items?

Nobody has the right to change these rules. You can find these rules in Article X.
(b) Change the method of determining the obligations, assessments, dues or other charges that may be levied per the terms hereof.
(f) Change the voting rights, assessments, assessment liens or subordination of assessment liens, except as provided for in this Declaration.
(g) Change the manner in which reserves for maintenance, repair and replacement of Common Areas have been setup and previously maintained by the Association.
