There is understandable concern and confusion regarding the Association's CC&Rs and residents' rights to receive over the air television broadcasts as defined by the Federal Government in the Telecommunications Act of 1996. Instead of attempting to explain the Act, it is suggested that interested parties access the Federal Communications Commission "Fact Sheet" on their website: http://www.fcc.gov/csb/facts/otard.html. In brief, the rule subordinates and preempts many restrictions, including CC&Rs, on the installation of antennas for the reception of television signals. This is of local importance as many residents have TV satellite dishes and would like to have free (non-cable) access to local TV stations. In addition, High-Definition Digital Television (home theater grade) signals are now being broadcast by the major San Diego and Los Angeles stations. These transmissions are only available over the air and not capable of being delivered by our current satellite and cable systems. Please note, the Telecommunications Act is not a "blank check" and contains reasonable definitions and restrictions which should be read and understood prior to any antenna installation. Lastly, if you decide to install an antenna within the definitions of the act, be sure to use a qualified professional installer who can measure the signals' strength at your home and chose an antenna and mounting location which minimizes the visual impact while yielding an acceptable quality signal as defined by the Act.
