AMENDED AND RESTATED DEED RESTRICTIONS
GENERAL INFORMATION SHEET

____Each Sharpstown section must approve the new Revised and Restated Restrictions by at least 51% (75% in Countty Club Estates East & West) of the lot owners before they can replace your section’s current deed restrictions.

____Other services paid for through annual assessments will be for the improvement of Sharpstown’s quality of life. Such as:

* SECTION Vi: 6.04. FIRST YEAR‘S MAXIMUMANNUAL ASSESSMEWT $72.

_____New $72 assessment effective January 1 for sections reach 51% (75% where required) by December 31 of any year.

_____Annual assessment may increase no more than 10% per year. Annual increase is NOT required.

_____Assessment may be reduced on annual basis either by lot owners vote or transfer of “quality of life” programs to other entities.

SECTION VIP GENERAL PROVISIONS, 7.04 “GRANDFATHER” CLAUSE

_____Any circumstances or conditions currently existing and not in compliance with the new Restated and Revised Restrictions shall not be required to be abated or removed.

_____Items previously Grandfathered may not later be replaced or renewed.

______Deed Restriction/Architectural Approval violations under current authorities would still be violations under Amended Restrictions.

Revised/Amended Uniform Deed Restrictions

REVISED/AMENDED UNIFORM DEED RESTRICTIONS

There are some misconceptions about the Uniform Deed Restrictions (UDR) which were highlighted by the notes on the 2003 Membership & Dues Form. Currently each piece of residential property within Sharpstown is covered by Deed Restrictions. These restrictions were written in the 50’s and 60’s as each section was built. Times have changed since then!

With the concurrence of a majority of the homeowners, the SCA Board contracted with our lawyers to update the existing recorded Deed Restrictions. Each section of Sharpstown would have one document in lieu of the existing multiple documents. The existing architectural controls and deed restrictions were not changed. The only article added was for have mandatory dues, initially set at $72 per year. There were provisions for collecting these dues, for raising or lowering the initial amount and for handling non-payments.

Section 1A is the only section that has implemented the UDR. Their dues have been $72 per year since 1997. There is a $5 per year late fee and 10% interest on all late payments. If payment is not received, a lien will be filed against the property. SCA cannot foreclose on any one’s home.

As each section reaches 51% owners signatures, these will be verified by the SCA office and sent to the City of Houston for review and recording. The ~ year following this filing, all owners in that section will be required to pay the $72 per year. (Note: Country Club Estates East and West must have 75% of the owner’s signatures).

Each owner of Sharpstown residential property benefits from the Architectural Control and Deed Restriction enforcement done by SCA. Volunteers — your neighbors — investigate reports of deed restriction violation. Permits issued by the City of Houston are noted and investigated by the Architectural Control committee volunteers. SCA dues are currently $50 per year. With mandatory dues, dues will be $24 per year.

The Constables on Patrol program (COPS) protects our community 24/7/365. This is in addition to the service provided by Houston Police Department. There are patrol units on the 63 miles of Sharpstown streets constantly. The current contribution is $135 per year. With mandatory dues, this will be $48 per year.

For many years, the owners wanting to keep Sharpstown a premiere place to live have paid their dues or the COPS or Both! Approximately 30% of the owners pay for 100% of the services. In no one’s math does that calculate.

SCA is NOT trying to change the existing deed restrictions. We are trying to consolidate the multiple parts of each section of Sharpstown into one document per section. We are trying to add mandatory SCA membership. Newer subdivisions have mandatory dues. At the time SCA was being developed, there was no need for mandatory dues. Times, they are a changing!

One owner referred to Mandatory Dues as a new Tax Collection and stated he would pay his dues when SCA gave up on trying to secure Mandatory Dues. If everyone paid their dues, there would be no need for mandatory dues. This is not a perfect world. Everyone will not pay voluntary dues. Everyone wants 100% service. For every privilege, there is a responsibility.
