The board did not elect to accept the ditch and did not have the chance to inspect it. It was passed from the developer Jon Saye to the HOA whom at the time was ALSO Jon Saye. There was not board to inspect the ditch at that time. I do agree with you on the idea of the cost of the lawsuit, it can be very expensive. I did not personally vote for the suit but do support that the majority of the subdivision did. The ditch settlement are in fact in very favorable negotiations right now and we are very hopeful that it will be resolved in the very near future. That is one reason why the 400.00 special assessment has not yet been billed. We are in fact very hopeful for an agreement with Jon Saye to stop all further litiagation.
