Specil Meetings Procedure

Special Meetings are held pursuant to specific rules and requirements. The nature of these rules was clearly and admirably established by the former President, Steve Lange, during the CVS
debate.

When those who had circulated their petition for a special meeting presented it to the President,
he initiated certain sequential steps. The first was to verify the authenticity of the names and that
the requisite number of signatures had been collected. The second was to prepare the notice of the meeting for delivery to the membership. He instructed me to prepare the notice subject to his review. I was instructed to use the precise wording from the petition for the notice. Robert?’s
Rules limit discussion at a special meeting to the specific item listed in the notice. By using the language from the petition, Mr. Lange was correctly limiting the issue to the wording of the
petition as signed by the members. Any attempt to deviate from the notice would be inappropriate.

The by-laws of the association state that the president shall conduct all meeting unless absent. This maxim includes a special meeting. The president has the prerogative, provided he is present, to turn all or part of a meeting over to a designee. At the special meeting on CVS, Mr.Lange was present at the meeting but chose to turn it over to someone else. He could
have conducted the entire meeting, the decision was his.

The board has tentatively scheduled a special meeting for October 10th at the request of Mr. Lange. No special meeting , howver, has been called to date by the president or the board. Once
the petition(s) is presented, the above steps will be initiated. Since a tentative date has been set, every effort will be made to verify the signatures, prepare the notice and mail it in time for the tentative date. Until then, however, no special meeting has been officially called.

i UNDERSTAND THAT ALL MEETINGS ARE HELD ON mONDAY EVENING. My job requires me to be out-of-town every week so I am not able to vote but I do participate on activities held on weekends and am a member of the association. My question- how do I do an absentee vote?

There is no procedure for absentee voting within the neighborhood. I looked back at an old newsletter and didn't see anything in the bylaws printed there about it either.

Soooo, Greg, the July 3rd Specially called Board meeting to oust me said nothing about voting in a new board member. (Cynthia Serra) A pretty serious bit of business. But that did not stop you from doing it and voting her on the board. (A swing vote if I remember correctly!!!) Your notice for that meeting said nothing about electing a new board member. I even objected to it but you went ahead anyway.

So much for following the exact language in the letter which initiates the special meeting. You guys wrote the letter and then bent the rules. But I guess it is O. K. for you because you have control of the board. So wouldn't you agree that we too should be allowed some latitude and not be held to strict adherance to the exact language on our petition and or the letter calling for the meeting?

What do you say? I would like to know.

Next you say that I relinguished the running of the special CVS meeting to CVS. Yes I did. What else would any reasonable person do. It was CVS's meeting not mine. It made all the sense in the world to let the person or group petitioning for the meeting run the meeting. The STOP CVS leadership wanted to talk to the STOP CVS supporters. Made sense. They sure did not want to listen to me or have me run what they considered was their meeting.

So that we can get this resolved here and now. I am asking you to allow us to run the meeting after you open it. Simply turn it over to us to run like I turned it over to CVS. If you are serious in your previous statements that I set the requisites for doing these kinds of meetings then you should see that I am correct in asking to be allowed to run it. (And just for the record, it will not be me personally, it will be someone else from our committee who would run the meeting.)

So what do you say. Please just post your answer here. I'll get it.
