Stone Mountain is a planned community consisting of 380 homes located in Stone Oak near Loop 1604 and Hwy 281. All Stone Mountain residents pay a monthly assessment fee, which maintains the community and its amenities. Not only do we enjoy the use of our swimming pool, tennis courts, children's playground, clubhouse and recreational facilities, but also those facilities and our landscaped common areas increase the value of our homes. The deed to your lot in Stone Mountain carries with it a permanent equal share in the Stone Mountain Owners Association and all its common property.

The Stone Mountain Owners Association

The Stone Mountain Owners Association (SMOA) owns and maintains the common facilities and properties of the association. Each Stone Mountain homeowner is a member of the association and owns an equal interest in those facilities and properties. All Stone Mountain residents pay a monthly assessment fee to maintain the Association's assets. Good care and maintenance of the commonly owned properties and facilities is important to the members in two ways: First, those facilities, especially the swimming pool, tennis courts, playground and clubhouse provide recreation for the community. Second, the shared ownership and the desirability of those facilities and properties have a positive affect on the selling prices of our homes when that time comes.

Deed Restriction (Protective Covenants) & Bylaws

The legal responsibilities of the association and every member (home owner) are described in two documents, the Deed Restrictions (Protective Covenants) and the Bylaws. Copies of these documents should have been provided to you at your closing. For a fee of $30.00 per document, ProComm (545-1888) can provide additional copies. The quality and character of a neighborhood can affect a home's value by five to ten percent. The Protective Covenants were designed to protect the value of your home and the integrity of the neighborhood. It lists certain rules about your property to which every homeowner agrees in order to purchase a home in Stone Mountain. The Stone Mountain Owners Association was created to provide a means by which all residents protect their investments in their homes. The intent of the Declaration of Protective Covenants is to protect the value of each and the integrity of the neighborhood as a whole. The Covenants are effective for an initial term of thirty (30) years, and automatically renew unless opposed by a proper vote of the members. Any homeowner, through the various committees and the Board of Directors of the association, may enforce the Covenants. The ByLaws work hand-in-hand with the Covenants. They outline the rules under which we, as a corporation, agree to govern ourselves through our Board of Directors and the committees that they appoint. The Bylaws specify the number of Board Members and the process by which they are selected. Their powers and duties are also listed, as is the method by which the Bylaws may be amended by the members of the Corporation.

Board of Directors and Officers

The Board of Directors consists of up to seven (7) Stone Mountain Owners Association members who are charged with the overall management and planning of the association. The following officers: President, Vice President, Secretary and Treasurer are selected by the Board of Directors. Vacancies occurring during the year are filled by appointments made by the remaining directors. Directors are elected for three-year terms with two/three terms expiring each year. Elections take place at the annual meeting of the Association.
