HOA Meeting

Well I was going to let this go, because I felt both of you really do not know what is going on.  But now I know you have no clue at all to what is going on.  First off you need to look at our By-Laws, our CCR's and all of the Arizona Statutes concerning HOA's and the rights of the members.  The Board and Oasis has broken over 6 Arizona Statutes and our By-Laws.  You think because someone like me finally calls them on it, you call it "Negitivity".  I call it Accountability.  The things that have happened and are happening with our HOA Board is exctly what has given HOA's a bad name.  Stand back for a minute and think, if the President of the United States broke laws do you think everyone should stand back and say "oh well I sure don't want to be Negitive and call him on it, I will just wait for a few months and then maybe I will run to see if I can become President.

I got involved when our Bank Account was down to $13,000.00 , this was from over $400,000.00 4 1/2 years ago, $13,000.00 is not enough to cover next months bills.  This was 4 to 5 months ago. 

As for the outspoken women, this is the first time I have even seen her at a meeting.  Besides other than her yelling into the mic I don't think anyone else heard anything she said other than calling everyone at the meeting "trailer trash".

Until Chad and Paul are gone being on the Board is pretty much useless.  Oasis again last night showed me their true colors, if you were at the meeting you witnessed them breaking Arizona Statute

10-3720. Members' list for meeting

A. After fixing a record date for a meeting, a corporation shall prepare an alphabetical list of the names of all of its members who are entitled to notice of the meeting. The list shall show the address and number of votes each member is entitled to vote at the meeting. The corporation shall prepare on a current basis through the time of the membership meeting another list of members, if any, who are entitled to vote at the meeting, but not entitled to notice of the meeting and the corporation shall prepare that list on the same basis and make it a part of the list of members.

B. For the purpose of communication with other members concerning the meeting the corporation shall make the list of members available for inspection by any member at the corporation's principal office or at another place identified in the meeting notice in the city where the meeting will be held. On written demand a member, a member's agent or a member's attorney may inspect and, subject to the limitations of section 10-11602, subsection C, and section 10-11605, may copy the list, during regular business hours and at the member's expense, during the period it is available for inspection.

C. The corporation shall make the list of members available at the meeting, and any member, a member's agent or a member's attorney may inspect the list at any time during the meeting or during any adjournment.

D. If the corporation refuses to allow a member, a member's agent or a member's attorney to inspect the list of members before or at the meeting or copy the list as permitted by subsection B of this section, the court in the county where a corporation's principal office is located, or if no principal office is located in this state, the court in the county where a corporation's known place of business is located, on application of the member, may summarily order the inspection or copying at the corporation's expense and may postpone the meeting for which the list was prepared until the inspection or copying is complete.

E. Refusal or failure to comply with this section does not affect the validity of any action taken at the meeting.

F. The articles of incorporation or bylaws of a corporation organized primarily for religious purposes may limit or abolish the rights of a member under this section to inspect and copy any corporate record.

  

I have sent written demand to view and copy the list of entitled voters.  This demand was made because Brett again stated we do not have enough entitled voters signatures on the petition.  Funny thing is at a month ago's meeting it was stated to us that 95% of the homes paid there dues.  I guess as luck has it, me and several others out there just happen to hit the 5% of the homes that were not current on there dues. I would also like to compare our petition against the entitled voters list, just to make sure.

"Do you realize that HOA is almost broke @ around 44K? This was after it was questioned by the community MANY times about spending on things such as Sun Shades at the park- don't get me wrong, that is a nice thing, but NOT WHEN THERE ARE ECONOMIC problems and many of the homes at that time were going through foreclosure. Why do I say that? Because the HOA doesn't receive dues from those homes, and causes a financial burden. That is just one example of un-necessary spending by our board--- not to mention that none of these expenditures are ever put out to vote--- because they don't have to."

In response to your sun shade comments, those were done a few years ago when our HOA had a TON of money. The economic problems weren't even a thought. This was brought to the board during a meeting, I am sorry I don't remember exactly when, but the group of people that attended that meeting supported it and the board voted right then and there to look into it and get a contract to do it. In my opinion this was money well spent! It keeps the kids from getting burned and the playground equipment from getting too hot to play on.

Look, I am not saying this board has been the best. But they are trying to fix the issues that they created and/or allowed happen. You can see the way the meetings are held. They are more formal than in the past. I am just as critical as the next person. Because that is my money being wasted!

Roughneck~ I was at that meeting that the Sun Shades were brought up. but at that meeting it was just for the board to look into how much it would cost not to go ahead and put them in. It was never voted on, But I do remember after they were installed we found out how much they were, I would think even if we did have the money at that time it should of been voted on by a ballot not by a few as you say that was quit a bit of money.

 I have notice that something may be brought up at a  meeting that we should do this or that and they would say we will look into it and then the next thing you know, it was done and they say we voted for it, just because it is brought up and we say okay go ahead and look into it doesn't mean go ahead and do it.

I have found out in many of the meeting I have attended and that would be most of them in the last 4 years we are told after the fact, So I can see why so many of the people are wondering what is going on, It was getting to the point that money was being spend and the members didn't know until after it was done. So if I or any of the other member's  have to ruffle some feather to find out what is going on then so be it.

I agree I don't have to be on the board just because I have  some questions that might not sound like a coom=bye-ah- meeting. so for the lady in pink~ who I dont remember seeing at any of the meeting but last night. really needed  to listen to the question that was ask, and wonder why it was never answered. but thanks to you and how you took over the mick none of us that wanted the answer will never know the answer.

As a former board member, I happen to be only one of three that resigned on the same night, I am here to say  that those of you questioning negativity really don't have any clue as to the issues at hand and reasoning behind the recall.

You can lam bast all you want and cheer for current board members spouses that scream, yell, and act in a manner that is appalling but you might want to wait to pass judgement until you have walked in another's shoes.

I care about this community just as many others do and I wholeheartedly agree you don't have to throw your hat in the ring to be involved but accountability is the heart of the issue here. For me personally,  I am not willing to sit idly by and let this community turn into something I am not proud to be a part of and more importantly watch my hard earned money be at risk of being mismanaged and things not being followed as they should be. Some of you see it just as an HOA, but its a real business and when a business is in jeoparday of failing you look at who's in charge of that business and hold them accountable.

If you are content with the way our business is being managed, so be it. It's your perogative just as it is for those who choose to do something whether you see it as negative or not.
