Deed Restrictions -GWTW!
Mindee: Again a good and worthy question. This is also a pet rock for me. The Association looked into Deed Restrictions about a year ago. First, the Old Bay Crest Deed Restrictions expired about 4 years ago. The DRs for New Bay Crest expired last Nov or Dec. WE FOUND and met with a lawyer who is an expert in DRs; mainly for NEW developments (she donated her time, over an hour, pro bono to help us). There is a reason for the fact that she specializes in NEW DRs, as I will explain. To either renew and extend, or put back in place DRs for Bay Crest, either in toto or by area, NEW, MIDDLE or OLD we would have to get the APPROVAL and CONSENT of every OWNER, yes all of them....For new areas they are written by the developer and when you buy in you sign up to whatever is in place. Getting current owners to sign up is almost beyond doing. Some are absentee landlords who may not care. Some owners are the very violators we want to have forced to correct what are aberrations or infractions on the good quality of life we all want to enjoy. That is the unfortunate situation. We were advised that to attempt to reinstate DRs now would be an effort in futility. We also learned that ONCE we residents had accepted, 10 foot fences (vice 6), 30 foot docks (vice, I think it was 12) and large storage sheds, et.al, then those DR limitations were basically null and void and violators could not be cited. Deed Restrictions
Larry, Thanks for your response. I was expecting bad news in regard to this question, but would still be interested in knowing what the original restrictions were. (Maybe I'm just a glutton for punishment to read what I can't do anything about!) With the restrictions pretty much null and void, I guess it's up to all conscientious residents to fully support all BCCA initiatives which which improve our neighborhood. By Mindee Cobb |

Deed restrictions - NOT
We moved here because there are NOT deed restrictions. We keep our house and surroundings exceptionally beautiful because we believe that is the way it should be...not because that is the way YOU want it. Please move away to a deed restricted community if that is what you desire and leave us alone. Most people in Baycrest are great neighbors and have always gotten along. Are you trying to change that? I hope not. |
