Dogs, Trees, Boundary, Son

Our neighbors' dogs have destroyed the lower half of our backyard fence. The only thing they have done to amend the situation is place parts of a children?’s playhouse in against the large hole, in hopes of preventing their dogs from entering our backyard.

Sadly, their dogs have also defecated in our backyard, thus rendering our lawn with a putrid smell and giving us some difficulty in mowing. In addition, their tree (which is entirely on their property but its branches lean out into ours) is scratching the tiles on our roof. We will not pay for the damages because of the growth of the tree. Furthermore, our next-door neighbor's son and his friends have littered on our property at two o'clock in the morning. This is unsettling and although we are kind people, we were hoping they had enough sense to do the right thing. However, their level of intelligence would seem to disprove that they have any sense at all.

Summarization of the Issues:

1. Dogs tearing down the lower half of the fence.
2. Dogs are defecating in our front and backyard property.
3. Their boundary trees exceed the normal height of the already present fence.
4. Their large tree's branches are scratching against our roof, and therefore might cause considerable damage later on in the future.
5. Their son's friends have littered on our property. We have pictures of the license plates and items thrown. I'm sure this is a violation against the Home Owner rules.

We are asking that they make the necessary repairs to the fence and hire someone to trim their boundary trees and the large tree in their backyard. Moreover, to inform their son to quit dumping garbage on our property, or else we will take them to small claims court if they do not cooperate.

We are a busy family and it pains us to have to do this, but their irresponsibility demands action.

I will write a letter to them explaining the situation, take pictures, and obtain cost estimates and opinions from professionals who specialize in this field.

Do you think I'm going about this the right way?

Yes you are.... It seems these Homeowners need to know "Enough is Enough"...... I hope everything works out on your behalf. Please update with any new information, it would be nice to see how this turned out.

I think you should discuss this matter with the lawyer that is being paid by your HOA dues. Let his office take control of this matter and find a solution to the problem. Another way to approach this would be to take your neighbor to arbitration down at the Bexar County Courthouse. There you along with them and a arbitor can peacefully come to an agreement. These are suggestions that should come from your Board Members and the Management Co., yet they are not. You could just spend the money for a new fence and let it go at that so your peace and serenity can return. This is meant only as a suggestion, I don't want you to think I'm telling you what to do. When we need help we ask. sometimes we feel we are asking for too much. If we have religous belifes we ask those at our place of worship for guidence.
