Good questions.   I've been led to believe that the Edwards Aquifer Authority has not grandfathered any wells past the original registering date.  Can someone research the court records to see the outcome of any lidigation.  Several here seem to be good at looking up public records on the net.   Open & factual disscussions are good, we all have a common interest here.

I too attended the HOA meeting..

I think this is the best course of action.  Just because the Edwards Aquifer Authority's rep told us at the meeting all of our options, that doesn't mean those are our only options (ie precedent in past litigation)

Has any one thought of petitioning our rep to the state government?  Maybe they could introduce a  bill to grandfather our well and grant us water rights?

With global warming having reached the point of no return, the lake has become a luxury we won't be able to afford any more. I think the only viable option is to cap the well, and start thinking about changing the name of our community to something else. The vast majority of residents won't be able to afford the increased assesments to pay for all that water plus lease costs for the water rights. Lets face it, things are only going to get worse in the coming years, at least until our children and grandchildren develope the technology to scrub the CO2 from the atmosphere.

You have to balance the cost of buying water against the cost of filling the lake. We can't just leave a big hole in the ground, it would be a swamp, mosquito breeding ground and all around environmental nusiance. I've run some very rough numbers and the MINIMUM I came up with to fill the lake is over $1,000,000 (yes, one million dollars). Thats a lot more than anyone has ever talked about paying for water.

We need to manage our water use better, but letting the lake go dry would be a much bigger economic hit on everybody than buying water rights.
