NATURE OF THE CLAIM:
James O?’Reilly was the President of the Circle C Homeowners Association for the last ten years. James O?’Reilly is also a friend of the Developer, Gary Bradley.
In the Year of 1995, Gary Bradley was the homeowner and also the resident of a house located at 6704 Edwardson Cove. Gary Bradley constructed a median in front of his house. Since this piece of land was located in the middle of the cul-de-sac and is also in front of five other houses, one of them being mine, it became a piece of common area. However, Gary Bradley treats this piece of land as his private land, and he abandoned it completely without finishing the landscape and stopped maintaining it after he moved away in 1996.
Since Gary Bradley left, this piece of land has been overgrown by long weeds about 90% of the year for all these years. During last nine years, I have requested James O?’Reilly numerous times to landscape this piece of land, but he ignored it. And also, James O?’Reilly was reluctant to enforce the restrictions on Gary Bradley.
According to the Association?’s financial statements over the last nine years, the majority of the homeowner assessments (association dues) go toward landscape maintenance on the common areas. I feel cheated because I have been stuck with this piece of messy, weedy raw land up to this day.
I wanted to hold James O?’Reilly personally responsible for the well being of this piece of land. As the President of the Circle C Homeowners Association, James O?’Reilly has the power either to use the association fund to landscape this piece of common area or to enforce the restrictions on Gary Bradley, but James O?’Reilly failed to do either; therefore, I want James O?’Reilly to refund 50% of my last nine years?’ (1995-2003) association dues for a total of $1,509.75.
