Dear Mr. Lloyd,

Thank you and your staff for spending time to dig out the real owner of the common area at the center of Edwardson Cove.

For all these years the Board of Directors has concealed the true identity of the owner of this piece of raw land. Mr. Bartlett even lied to me by telling me that Travis County owns this piece of land; I still have a copy of his e-mail.

Thank you for suggesting me to contact City of Austin Solid Waste Services to clean up the weeds. Don't you think it is an insult to Mr. Bradley to have Solid Waste Services to clean up HIS land?

I am determined to take Mr. Bradley and the Board to the court to solve this weeds problem.

PURPOSE OF ASSESSMENTS

July 15, 2003

Dear Board of Directors,

According to our Declaration of Covenants, Conditions and Restrictions, the assessments levied by the Association shall be used exclusively for the purpose of promoting the comfort, health, safety, and welfare of the owners of the properties.

Please tell me what kind of comfort I have by living with a piece of messy, weedy raw land for eight, long years.

Please also tell me how safe it was for me to live under a dead tree with falling branches and debris for two, long years.

I, therefore, decided to stop paying the association fee until this piece of Gary Bradley?’s ?“common area?” is installed with sprinkler system and Asian Jasmines.

Dear Ms. Sun:

I apologize, but after reading your latest email, it appears that the information I sent you in my previous email referred to a completely different piece of land than the area that you are complaining about. City staff looked at a vacant 21 acre tract that is located adjacent to the rear of the lots on the north side of Edwardson Cove, assuming that this was the Edwardson Cove ''common area''. They did not look at the area in the center of the cul-de-sac at the end of the street. I am sorry about this error.

At this time, we have not determined what the ownership is for the center area in the right of way from TCAD records. I am informed that it is not shown on the subdivision plat and it is not shown on the tax plat. I believe it was not included in the areas which are maintained under the City / CCHOA license agreement.

Again, I apologize for the confusion.

Thank you for your clarification. Thank you and your staff again for spending time to find out the ownership of these lands.

Last year I was told by CCHOA's Vice-president, Steve Bartlett, that this piece of round shape median land belonged to Travis County. To be frank, I really don't care who owns this piece of land because as a homeowner, it is not my responsibility to confront the owner and enforce the deed restrictions. Enforcing the deed restrictions is the duty of the Board!!!

I consider myself a patient person. However, no matter how patient I am, there is a limit. After more than eight years of living with this piece of messy, weedy land, I have had enough with it. Therefore, I determine to take Gary Bradley, Jim O'Reilly, Steve Bartlett, Ken Rigsbee and Susan Hoover to the court to solve this weeds problem once for all.
