For once and for all.. was the lawsuit expense covered by insurance and the only reason the insurance company did not pay is because the BOD did not notify them??? Will the BOD please admit or deny this ? Did the BOD Throw away $100,000 of our money ??? If so, then the 3 BOD member need to cough up $33333.33 each. BOD!! Please say it isn't so.!!!!

Confirm it yourself. The Board may not answer your question adequately. Example why I say that: O'Reilly previously, and adamantly, refused to tell me the insurance contact for the CCHOA - But I found out anyway.

Call Teri Giles, our bookkeeper at Giles and Shea. She told me the legal expenses for 2003 for the CCHOA were nearly $97,000 booked. These primarily include defense expenses for the Gammon lawsuit. Very little other dollars in there. She didn't know whether the CCHOA had filed an insurance claim.

I spoke with the insurance agent, Jack Sr. His office is in West Columbia, Texas - near Houston. He told he there had NOT been a claim filed against the insurance. When I asked if there had been a claim filed against the insurance, would it have covered the defense costs for attorney fees. Answer: Yes, if it had been filed. Jack, Sr. was very nice and very informative.

The Board wasted your money. They had adequate insurance coverage, but the Board spent your nearly $100,000 unwisely.
