Poll: RETRIBUTION?

Many weeks ago the Judge ruled the CCHOA could hold its election right away.

It's unknown why the 3 BOD have chosen not to have an election or set a date. And, to make matters worse, they seem to have difficulty with giving straight answers of when the election will be held.

For the past many weeks, Circle C court battles had ended. As of yesterday, the BOD of 3 have filed a lawsuit against Bill Gammon for CCHOA lawyer fees to the tune of tens of thousands of dollars.

FYI: Bill Gammon DID NOT ask for his legal fees to be paid in the past CCHOA court issues. He simply asked the court to make the 3 BOD provide a voter list as per Texas law, and make CCHOA records available for all residents as per CCHOA governing documents.

The Judge gave both sides almost equal wins to make a compromise, to end the battles. Because of that split of rulings, it's unlikely that Bill Gammon will ever have to pay a dime. But the residents of Circle C will certainly have to pay much more to the high priced ''Gray & Becker'' Attorneys the 3 BOD have hired.

Answer these POLL questions:
1. Should the 3 BOD set a date for the election immediately?
2. What are your thoughts on the 3 BOD seeking to restart the legal machine and escalate your CCHOA court costs with suing Bill Gammon?
Bill Gammon should be sued

I don't often agree with the BOD, but this time I sure do. Gammon's lawsuit was a complete waste of everybody's time and money, except apparently for his. What did the judge give Gammon? Nothing except for a greatly reduced e-mail list. Otherwise, his case was completely thrown out for being frivolous. It's not proposition 12 that's going to stop frivolous lawsuits; it's slamming lawyers who file them like Gammon.

The Judge forced the law on BOD

The Judges signed order forced Rigsbee, O'Rielly & Bartlett to publish the voter list as stated by Texas law, and it outlaws any caps on your voting rights.

Emotions aside, we as CCHOA members will be paying many more tens of thousands of dollars to proceed with suing Gammon.

NOTE: The same 3 BOD chose NOT to use the D&O Insurance we paid for, for these what are now escalating legal costs.

the BOD should call the election immediately, but I hope the petition to increase the BOD to 9 members is also effective
