REVISED FENCE POLICY

August 2002

RESOLUTION # 02-08-01

Subject:Fences

WHEREAS, the Board of Directors of Ventura Homeowners’ Association Inc., is empowered to govern the affairs of the Homeowners’ Association pursuant to Article IV of the Bylaws.

WHEREAS, there is a need to establish a defined fence policy for the Ventura Homeowners’ Association.

WHEREAS, it is the intent that this resolution shall remain in effect until otherwise rescinded or amended by the Board of Directors.

NOW, THEREFORE, BE IT RESOLVED THAT the following decision has been adopted by the Board of Directors:

RESOLVED: The policy is established to provide additional guidance and directive pertaining to Article 13, Fences, Walls, and Hedges and Article 18, Maintenance of Residential Lot as established by the Declaration of Restrictions. A free how to instruction pamphlet on fences is available at the VHA office.

1. Construction of new fencing or modification to the existing fencing requires the approval of an Architectural Control Request (ACR). Where fencing is to be placed or replaced on the shared property line between two or more lots, a joint application by both parties or one application with the joint owner(s) approval. No shared fence should be replaced or repaired without first making contact with the joint owner. The Association will not get involved in settling disputes of cost and expense for replacement and/or repairs. All repairs and replacement expenses should be shared by all owners. An ACR is not required for repairs provided no changes are made to the existing fence, ie; height, location, style, and materials.


2. All fences will be faced with wood, brick, stone, or vinyl, or some other material approved by the Association. Chain link fencing will not be allowed. Metal posts are acceptable. Any fence that faces the street must conform to paragraph 4 a and b. Gates may be added to the rear fence and both sides of front fence between houses. An ACR is required. Solid board fences that face the street, or can be seen from the street, or face a vacant lot, must have the horizontal rails or post facing inward towards the house.

3. Fences made of brick and wood, or stone and wood, may be approved and allowed, provided the brick, stone and/or wood match the existing house and the quality of workmanship, materials, design, and colors are in harmony with the design of existing structures. Any brick or stone incorporated into the existing fence shall be in harmony with the design and color of the existing fence. An ACR must be submitted for approval prior to installation.

4. All wood fences and gates must be solid in appearance and shall not be of “open” picket or “rail” design. Acceptable wood fencing includes the following designs (see exhibit A):

a. Solid board or privacy made in picket styles such as: Dog-ear, Flattop, Gothic, Pointed.


b.Board on board.


c.Woven or basket weave.


5. Wood fencing material (e.g., slats, boards, or pickets) will not be wider than six (6) inches. The same size boards must be used for the entire fence. Posts will not extend beyond the tops of the fence. Picket tops must be aligned to ensure an even appearance. Raising and lowering may be needed to adjust for grade.

6. No fence shall be less than four (4) feet, nor more than eight (8) feet in height above ground level. The height of the fence should be consistent with the surrounding fences. Exception would be any fence that faces an easement which can be taller than the existing fences.

7. When replacing only a portion or section of the existing fence (as opposed to replacing the entire fence) because of rotted, worn, broken, or otherwise damaged fencing material, the replaced portion or section shall be the same width and height above ground level as the existing fence. The pattern of the new fence must be continued to match the existing fence. A mismatch of the new fence standards will not be acceptable. The only exception will be for gates that face easements. These may be constructed of solid board versus the woven style. The gate must conform to the same height of the existing fence.

8. When a portion of old or existing fencing is being replaced and new fencing is installed and the existing fencing is painted or stained, the new fencing shall be painted or stained to match the existing fencing as closely as possible.

9. Effective upon approval of this new policy no existing fence that has not been painted or stained or new fence, can be painted or stained. All wood fences and gates shall be left natural, covered with a natural clear stain, or covered with a clear preserver. A clear stain would be one that the wood grain is still visible.

10. All property owners adjacent to the Spring Meadows Elementary School will be required to maintain their rear fence or replace the existing rear fence with a privacy fence. Attaching to the school’s chain link fence will not be allowed. The school fence is inside their property line and therefore not a common boundary line.



This Resolution supercedes Rules and Procedures Property Perimeter – Privacy

Motion was made, seconded, and approved by unanimous vote during the VHA Board Meeting recorded in the Book of Minutes dated August 28, 2002 (see minutes).
