MINUTES OF VILLA MARBELLA MONTHLY H.O.A. MEETING MAY 24, 2001
(The monthly meeting of the Villa Marbella Homeowners' Association Board of Directors was called to order at 7:00pm Thursday May 24th , 2001, in B-205 (Bert Donaldson's' condo)).

Minutes. (Note: Minutes of the April 21st Annual Meeting were mailed to owners about April 26th.)

2) Status of Delinquent Accounts. The situation regarding delinquencies has changed completely since last discussed in the March meeting. The lien that was in place on a B-Bldg condo was settled (paid off) by the owner. Two other B-Bldg condos which were seriously delinquent (one was in bankruptcy) had the delinquencies paid off recently, when their owners sold the condos. Recently two condos, one in A-Bldg and one in B-Bldg became about $200 delinquent, and "pay or lien" letters will be sent to them. The status of other delinquencies was dis-cussed.
3) Work Authorizations: #781-#787 were discussed. #786 was to build a water diversion channel where pool and spa water comes out into the parking lot. #787 was to replace some faded signs.
Old Business:
1) Garden Window Work. This month the discussion about garden windows delved into what should be the next step in getting some reattached to the buildings. Bert Donaldson offered to use his window to demonstrate how to tighten a window to the building with long screws, like a contractor suggested. There was also a discussion about the boards that are sagging from the bottom of a few windows. Following up on a motion passed at the Annual Meeting, the Board passed a MOTION that the manager should send letters to the three condos with badly sagging boards from the bottoms of their windows to get those boards repaired.
2) Parking Lot Repair & Seal. The Manager was asked to proceed with arrangements for parking lot asphalt repair, seal and restriping.
New Business:
1) Serious Water Damage. There was a long discussion about the most serious damage at Villa Marbella that anyone could remember. The discussion started with a description of what happened. A worker in B-311 was doing various handyman repair jobs on Friday May 4th. He apparently wanted to replace a leaky toilet valve. About 5pm the valve shot off the pipe, bruising him in his wrist when it flew off the pipe by the force of the water. It took about 30 minutes before a knowledgeable resident was shown the problem. An offsite Board member, reached by telephone, couldn't adequately explain how to shut off the water. (NOTE: Use the valves by the water heaters.) About 30 minutes later, after thousands of gallons of water had shot out the pipe, the Board member arrived and shut off the water to that part of the building.
The HOA's property manager, Dan Little, arrived quickly, too, along with various emergency repair contractors. Water removal and carpet drying was done that night. Ceiling, wall, and/or carpet damage was noted in five condos. The Manager subsequently met with representatives of the HOA insurance company and Emercon repair contractor regarding repairs. Repair costs are expected to be well over $10,000, and the responsible owner should be billed for what exceeds the insurance deductible, and should pay for most damaged carpets. A MOTION passed authorizing Dan Little to approve a suitable insurance-covered repair proposal. Apparently no payments by the HOA itself are anticipated.
2) HOA Board Officer Selection. (Secretary's Note: Per CC&Rs, the HOA Board members elect their own officers.) After a brief discussion, a MOTION passed naming the following as officers on the HOA Board of Directors: Chuy Ma, President; Gabe Schmera, Vice President; Sylvia Lang, 2nd Vice President; Dan Divine, Treasurer; Bert Donaldson, Secretary.
3) Signature Cards for Bank Accounts. The desire to have updated bank account signature cards with the current Board members was discussed. A MOTION passed to get updated bank signature cards.
Adjournment to Executive Session. The meeting was adjourned to Executive Session about 8:15pm. During Executive Session a monetary penalty case was considered regarding parking in fire lanes. A $25 monetary penalty was approved by MOTION.
