MINUTES OF VILLA MARBELLA H.O.A. ANNUAL MEETING APRIL 17, 2004

(The annual meeting of the Villa Marbella Homeowners' Association was called to order by HOA Manager
Dan Little at 10:00am Saturday April 17th, 2004, in Sizzler Restaurant, 2855 Midway Drive).

There were 8 owners in attendance (counting shared ownerships as one). Counting nearly 40 proxy forms, a quorum of 45 was obtained, and the meeting began at 10am.

Minutes. Minutes of the April 2003 Annual Meeting were summarized. (Note: Minutes of the March 4, 2004, monthly meeting were mailed to owners about March 26, 2004.)

Election of Three Board Members. Sign-ins, ballots, and ballot counting were handled by the “impartial ballot committee” of John Anderson and Bob Mohle. Three of the HOA Board members during the preceding twelve months were candidates for reelection. Mr. Chuy Ma, the Board’s President, Gabe Schmera, Vice President, and Peter Thung, Treasurer, were the previously-announced candi-dates. When Manager Dan Little, who presided over the meeting, asked for other nominations, and there were no others, a MOTION passed electing all three without balloting.

Discussion Session. “Topic cards” turned in by people at the meeting and Comments on Proxy Forms were used to lead the discussion session.
1) Elevators. A big topic was elevators. Many aspects of the A-Bldg elevator outage from December through March were reviewed. The problem was primarily disagreement over repair responsibility. It took another elevator company, which was one of two other companies that bid on providing new service, to locate repair parts in March. The discussion also covered obsolescence, how to switch services, how to get new elevators (estimated at $200K each), reserve funding for elevators, and handicap access.
2) Rule Violations and the problems they cause, taken as a whole, was the major topic of the meeting. Parking in Fire Lanes and in unauthorized spaces creates hazards and difficulties. The towing process was streamlined, and towing will be stepped up. (Secretary’s Note: Villa Marbella parking decals are available on site and from the manager, and people should use them to identify vehicle owners prior to tows.) Loose pots on balcony railings are safety hazards, cause littering and nuisance, and the HOA should take actions. Doors Propped Open, another rule violation, is serious especially near the pool. Cameras can identify people propping doors open. Noise (someone mentioned 2nd floor condos) is a serious problem. People can either ask noisemakers to be quiet, or report them to the Manager who will contact the owners.
3) The HOA’s Antenna on B-Bldg Roof to get local stations could be repaired and upgraded.
4) Pool Heating is usually during months of Daylight Savings Time.

Adjournment. Annual Meeting was adjourned at 10:35am.

Board Meeting was called to order about 10:50am, with Dan Little, Lana Ivascu, Donaldsons, Peter Thung, Etsuko Tsukagoshi, John Anderson, and Carmen Fullbright in attendance. Board members named themselves to the same officer positions they previously held by MOTION. Mr. Ma will be President, Gabe Schmera, Vice President, Lana Ivascu, 2nd Vice President, Peter Thung, Treasurer, and Bert Donaldson, Secretary.

Services (a grouping of the following fixed fee HOA service expenses: Trash, Janitors, Pool Service, Elevator, Pest Control, Gardening, Inspection, Gate Phone): $3871
Maintenance & Supplies (non﷓routine repairs & maintenance, and supplies): $3721 Audit & Tax Preparation: $825

Vehicle Gate Entry Box Key Pad had been working intermittently. Although parts for the box (Entraguard PM4-100HF, from 1987) are very hard to get, the company that acquired Entraguard agreed to help us. A MOTION passed authorizing up to $800 to get & install a new key pad, plus a spare.
Storm Drain Grate was ordered because the old one rusted and broke. (New one was installed in early May.)
Owner Responsibilities should be publicized more. For example, owners and even renters should have insurance (HOA’s policy has a $5000 deductible), and owners are responsible for fence and plumbing maintenance.
