Minutes of Meeting of November 2000

MINUTES OF VILLA MARBELLA MONTHLY H.O.A. MEETING
NOVEMBER 20, 2000

(The monthly meeting of the Villa Marbella Homeowners' Association Board of Directors was called to order by Beverly Powers at 7:00pm Monday November 20th, 2000, in B-306 (Beverly Powers' condo)).

Minutes. (Note: Minutes of the October 23rd meeting were mailed to owners about November 26th.)

Homeowners Session:
1) Parking In Fire Lanes was cited as a serious problem. The HOA could be held liable for not enforcing parking rules in case of situations such as fire trucks not able to get in. The Board took an Action Item to see if the Manager can call or FAX tow authorizations to a towing company.
2) Homeless Transient on Property. A complaint was made that an apparently homeless guy was acting rudely by an A-Bldg dumpster. The HOA should check to see if proper "No Trespassing" signs are in place.
3) Doors Propped Open was a concern of several people. It was cited as a serious security problem. Open doors are an open invitation to anybody to walk in. The Vice President reported that homeless-looking people are sometimes in the hallways.
4) Budget & Dues Increase. (Note: In October, the Board approved an increase from $143 to $155 per month effective Jan 1, 2001.) Mr. Klahn said the increase is a serious concern. From his perspective, the increase adds no value to his unit, and he doesn't see the Board trying to cut expenses.
Treasurer Dan Divine cited some of the cost-cutting proposals discussed in the October meeting. Most cost increases are imposed on the HOA (electricity, water, trash, etc.), and countering the increases, the Board will probably take actions such as reducing the lighting, and possibly looking for a new pool service. Regarding costs due to vandalism, the Board may vote for special assessments to cover those repairs.
5) Committees. Paul Klahn agreed to be on the Budget & Finance Committee. (Note: Subsequently, Albert Leggs, Warren Riley, and John Anderson also agreed to be members of the Budget & Finance Committee. People with interests in HOA matters are urged to join any of the committees. Other committees are Pool, Parking, Landscaping, and Maintenance Committees.)
6) Cameras/Surveillance costs were questioned, and it was reported that new video monitoring equipment was already purchased (for fumigation). Someone recommended putting surveillance cameras inside the elevators.

Financial Report:
1) Financial Summary: (taken from financial statements)
Money in Bank Accounts 9/30: $111,389
Money in Bank Accounts 10/31: $110,326
Decrease: $1,063
Payments During October: (totaling $15,429):
Administration: $1175 Insurance: $2089
Sewer & Water: $3523 Gas & Electric: $4089
Services (a grouping of the following fixed-fee HOA service expenses: Trash, Janitors, Pool Service, Elevator, Pest Control, Gardening, Inspection, Gate Phone): $3323
Maintenance & Supplies (non-routine repairs & maintenance, and supplies): $1230
Gas & electric payments ($4089) were for about one & a half months of service. Insurance payments ($2089) were for 2 months' payments plus fidelity bond.
2) Status of Delinquent Accounts. The HOA should have one lien in place for delinquent assessments, and it is on an A-Bldg condo about $1000 delinquent. The status of other delinquencies was discussed.

Old Business:
1) Modifications to Exclusive Use Common Areas. Regarding changes that owners make to HOA property, Bert Donaldson asked what the general policy is. Speaking without opposition, President Powers said people must submit written requests, the Board should be flexible, and new owners can't be faulted for changes made by previous owners.
2) Window and Railing Inspection plans were discussed for a while. After trying to re-establish a "game plan" (last cited in September meeting), it was agreed to send out notices that people who would like their railings or garden windows inspected for damage and possible HOA-paid repairs should respond to HOA management. A MOTION passed that a draft notice will be circulated.
3) Mailboxes will be painted (MOTION passed).
New Business. Parking Space Switched. Shelly Dowell, new owner of A105, wondered what to do with information that the spot they use is not the "official" spot per HOA records. Bert Donaldson reported that A309 people probably has worded out a switch with the previous owner. The Manager recommended that the HOA not sanction such changes, because lawyers may need to be involved.

Adjournment. The meeting was adjourned at 9:00.
