MINUTES OF VILLA MARBELLA H.O.A. ANNUAL MEETING APRIL 20, 2002

(The annual meeting of the Villa Marbella Homeowners' Association was called to order by HOA Manager Dan Little at 10:00am Saturday April 20th, 2002, in Sizzler Restaurant, 2855 Midway Drive).

There were 16 owners in attendance (counting shared ownerships as one). Several proxies were available, which allowed the meeting to begin at 10am.

Minutes. Minutes of the April 2001 Annual Meeting were summarized.

(Note: Minutes of the March 7, 2002, monthly meeting were mailed to owners about March 26, 2002.)

Election of Three Board Members. Three of the HOA Board members during the preceding twelve months were candidates for reelection. Mr. Chuy Ma, Board President, Gabe Schmera, Vice President, and Bert Donaldson, Secretary, were the three candidates, and they each made short statements. Manager Dan Little, presiding over the meeting, asked for other nominations, and there were none. The three Board members were reelected by consensus.

Discussion Session. “Topic cards” and Proxy comments were turned in by people to indicate discussion topics.
1) Ants. Dan Little gave overview of the HOA’s pest reduction program, including exterminator’s discount to treat individual condos.
2) Garden Window Repair. The history and background of the issue were discussed. There has been a concern over garden windows sagging away from the buildings, and the situation primarily affects 3rd floor condos that face towards downtown. There’s also a hope that tightening windows to the building will reduce leaking during rainstorms. Parts recently were obtained to begin initial reattachment repairs. It’s still not decided if HOA or individual owners would pay for repairs. (Secretary’s Note: It was previously reported that the Budget & Finance Committee recommended that owners with windows in need of repair should bear the cost of the repairs, and a survey of owners found 2:1 favored the same thing.)
3) Painting. Lana Ivascu, head of the Architecture & Landscaping Committee, presented artist depictions of paint color choices. Professionally prepared concept boards will be displayed in building lobbies for comments by any interested people.
4) Landscaping. There was mention of a landscaping plan, and questions about a dead palm tree by Yum Yum Donuts.
5) Noise Violations. Some people thought it’s unfair to charge $25 for noise or other violations if the last violation was over 2 years ago. Others said it’s unfair for people to get away with such disturbances, and the hearing process takes into account violation severity and when the last one occurred.
6) Drug Store - Walgreens. There was discussion of potential parking & other impacts of new Walgreens.
7) Cellular Telephone Antennas. It was estimated that the HOA could get as much as $2000/month by renting roof space for cellular telephone antennas.
8) Emergency Access. Some people thought the HOA should make more effort to contact absent condo owners prior to going into a condo to remedy an emergency (flooding or fire). They were told such emergencies usually don’t allow time to summon absent owners.
9) Access to Water Heaters and Water Cut-off. Water heaters and cut-off valves are common area property on six patios. Residents must be notified prior to non-emergency water cut-off.
10) Insurance for Condos. Owners should be urged to get adequate insurance, including for “loss of rents” for non-resident owners.

Adjournment. Annual Meeting was adjourned @ 11:30.

Board Meeting was called to order about 11:35am. Board members named themselves to the same officer positions they previously held by MOTION. Mr. Ma will be President, Gabe Schmera, Vice President, Sylvia Lang, 2nd Vice President, Dan Divine, Treasurer, and Bert Donaldson, Secretary.

Executive Session. Three monetary penalty hearings were held. Fees were approved for noise, parking and maintenance violations, but two were suspended pending no repeat violations.
