May 2000 Minutes of HOA Board Meeting

MINUTES OF VILLA MARBELLA H.O.A. MEETING
MAY 18, 1999
(The monthly meeting of the Villa Marbella Homeowners' Association Board of Directors began at 7:00pm Thursday May 18, 1999, in B-205, and a quorum was reached at 8pm ).

Minutes. (Note: Minutes of the April 22nd Annual meeting were mailed to owners about May 26th.)


Homeowners' Session:

1) Carpet Removal Problems. Another owner reported serious noise problems after carpet was removed from the unit above. The owner's tenant reportedly left due to the noise. A long discussion went over various points such as removal of 2nd or 3rd floor carpeting and subsequent use of tile, wood, or another hard substance, is contrary to the noise reduction originally designed into the buildings, and may in and of itself be a violation of the CC&Rs. The Manager will discuss options with the HOA attorney.
2) PetsMart Dumpster Noise. Owners with condos facing PetsMart ("back side" of the A-Building) again reported continued problems with their trash dumpsters. The pickups are still noisy and before 6am. Also, since they are not locked, homeless people rummage through them at all hours. The Manager reported continuing attempts to get PetsMart to move the pickup time to a later hour. Various renewed efforts will be taken to reduce the problems.
3) Enclose a Balcony. One of the owners whose condo faces PetsMart asked for permission to enclose their balcony like another has done. The owner was asked to submit a plan.
4) Air Conditioner. The owner of A-313, also on the "back side" of the A-Building, submitted a written request for installation of an air conditioner. One Board member had a question about the installation, so the owner was gotten on the phone and the question was answered. The request was then approved by MOTION.

1) Financial Summary: (taken from financial handouts)

Payments During April (totaling $12,679):
Admin: $900 Insurance: $831

Services (a grouping of the following fixed-fee HOA service expenses: Trash, Janitors, Pool Service, Elevator, Pest Control, Gardening, Inspection, Gate Phone): $3260
Maintenance & Supplies (non-routine repairs & maintenance, and supplies): $1197 Legal & Licenses: $345
Pool & Fountain Extras: $1466

2) Correction to April Minutes: There were 12 owners (not just 11) representing 18 condos at the Annual Meeting - John Anderson was at the Meeting, but was not listed in the Minutes.
3) Status of Delinquent Accounts. Two liens on A-Bldg units were cleared. A-104 was repossessed a few months ago with cooperation of survivors of the late owner. Considering that A-104 has been vacant, and that survivors have recently helped the HOA with other related matters, a MOTION passed to "write off" the debt of about $1300. The other lien debt was paid.


Old Business:

1) Fumigation Scheduled for July 17-19, 2000. A MOTION passed to get a locksmith and an eviction marshall on site July 17th in the morning.
2) Authorizations Since the March Meeting. Work order authorizations numbered #731 through #735 were discussed. #732 was to trim and prune the pine trees.
3) Carpet Cleaning. Dan Little discussed some of the problems that have been noticed regarding the carpet cleaning being done by Coit Carpets. The Coit Carpet contract is a few months old, but it can be cancelled. The Manger told Coit Carpets that so far Villa Marbella HOA is very dissatisfied with the service, and the HOA will monitor the cleaning efforts closely.
4) Extra Parking Waiting List. The Manager reported that there are three or four people on the waiting list for extra parking ($35/month). (Secretary's Note: The waiting list is 1) P. King, 2) C. Fullbright, 3) G. Schmera, 4) S. Lang, 5) M. Hernandez, 6) B. Wilson, 7) J. O'Rourke, 8) D. Divine, 9) E. Salcedo, and 10) L. Robertson.) .


New Business:

Election of Board Officers. (Secretary's Note: This (May) meeting is the first Board meeting in the new term of office which began at the April Annual Meeting. The Board members elect the officers for the term as soon as possible.) After discussion, a MOTION passed electing Beverly Powers as President, Chuy Ma as Vice President, Dan Divine as Treasurer, and Bert Donaldson as Secretary.

Adjournment. The meeting was adjourned to executive session about 8:15pm.

Executive Session. The Board approved 4 monetary penalties. Three resulted from noise, and one regarded access for fumigation.
