MINUTES OF VILLA MARBELLA MONTHLY H.O.A. MEETING OF DECEMBER 5, 2002

(The monthly meeting of the Villa Marbella Homweowners' Associstion Board of Dirctors was called to order about 7:00pm Thursday December 5, 2002, in B-205 (Bert Donaldson's condo))

Minutes. (Note: Minutes of the November 7th monthly meeting were mailed to owners about November 26th.)

Homeowners' Session:
B213 Getting Water From Above. Mr Marquez from B213 reported a water leak in one of his bathrooms. It was not clear where the leak was coming from, or how bad the leak was, so the Board went into a 10-minute recess so some Board members could go into B-213 and examine the leak. It turned out to be a dried up, but visible leak from the top of B213 bathtub, apparently from the bathroom above. [Subsequently, there was a plumbing repair in B313, which may have solved the leak.]

1) Financial Summary (taken from financial statements)

About $4000 was spent to replace a water heater behind B-112.

Services (a grouping of the following usually-fixed-fee HOA service expenses: Trash, Janitors, Pool Service, Elevator, Pest Control, Gardening, Inspection, Gate Phone): $3731

2) Status of Delinquent Accounts: A lien is in place on an A-Bldg condo that is about $1400 behind. Another lien is in place on a B-Bldg condo that is about $900 delinquent. A lien is being requested on an A-Bldg condo that is about $400 delinquent. Other delinquencies were discussed.

3) Pay or Lien Letters Will Now Cost at Least $125. Delinquent owners had been charged up till now, typically, $50 for pay or lien letters when they got 30 days delinquent. The charge will now be at least $125. The HOA Board approved by MOTION letting an attorney send the pay or lien (delinquency) letters. The reason for the change is because California (the state) implemented a new law regarding procedures to be followed regarding pre-lien procedures. The new procedures are so complicated that it is now beyond the ability of most people to understand or follow the steps to follow in the pre-lien procedure.

4) Monthly Fees Increase to $167 per month, as approved in the November meeting.

Old Business:
1) Exterior Wood Painting. Draft specifications are still being reviewed, and color may be affected in case awnings are changed.

2) Work Authorization #842 was to repair a door closure in the center of the B-Building 2nd floor hallway.

New Business:

1) Awnings Ripped: The awning over the main entrance to the B-Bldg ripped apart at a seam. There was discussion about how soon it could be replaced. Lana Ivascu would like to get a different color. Awning companies will be contacted for estimates.
2) Routine Expenses. The Board approved by MOTION a tally of "routine expenses" that do not need additional Board approval to pay the bill. No one could find the previously approved tally, so this tally was based on memory: Approved Services (janitorial, trash, pool service, elevator, pest control, gardening (landscaping), inspection, and gate phone), Utilities (water & sewer, and gas & electricity), Management, Insurance, Taxes, Fire Alarm & Extinguisher Inspections, Pool Inspection & Permits, Elevator Inspection & Permits, Trash Chute Clean-out every 6 months, and the recently approved (October 3rd) Door & Lock Repairs, and intermittent Drain Leaks (reference October 3rd minutes for qualifications).

3) Owners Responsible for Costs Due to Modifications. In a move to clarify a MOTION in the September 5th meeting that prohibits most modifications without proper approval, the Board passed another MOTION reaffirming the policy that owners will be responsible for all costs for restoration or maintenance, including any additional maintenance costs, that result from the alterations done in their condo.

Adjournment. The meeting was adjourned about 8:00pm.
