Minutes of Meeting of February 2001

MINUTES OF VILLA MARBELLA MONTHLY H.O.A. MEETING FEBRUARY 22, 2001

(The monthly meeting of the Villa Marbella Homeowners' Association Board of Directors was called to order by Beverly Powers at 7:00pm Thursday February 22nd, 2001, in B-205 (Bert Donaldson's' condo)).

Minutes. (Note: Minutes of the January 18th meeting were mailed to owners about February 26th.)

Financial Report:
1) Financial Summary: (taken from financial statements)
Money in Bank Accounts 12/31: $115,915
Money in Bank Accounts 1/31: $119,729
Increase: $3,814
Payments During January: (totaling $11,182):
Administration: $1088
Insurance: $837
Sewer & Water: $2961
Gas & Electricity $1238
Services (a grouping of the following fixed-fee HOA service expenses: Trash, Janitors, Pool Service, Elevator, Pest Control, Gardening, Inspection, Gate Phone): $3308
Maintenance & Supplies (non-routine repairs & maintenance, and supplies): $1750
There was another credit applied to the electricity bill, so the cost of electricity was reduced again in January.

2) Status of Delinquent Accounts. One lien is in place for delinquent assessments, and it is on an A-Building condo about $1500 delinquent. The status of other delinquencies was discussed. Three condos in the B-Building are between about $400-$800 delinquent, and liens are being placed on them.
3) Electricity Costs. Once again electricity conservation was discussed, and the possibility of shutting off some lights was discussed.

Old Business:
1) Garden Window Inspections. This month the discussion about building inspections was more or less just about inspecting the garden windows. The multi-year history of the growing concern over loosening garden windows was reviewed. Various possible courses of action were discussed again. The Manager had gotten a bid from a maintenance company named Pro-Tek to inspect the garden windows for $1260. A MOTION passed to accept the offer with two provisos: (a) There must be a unit by unit itemization of window condition, and (b) The HOA must be able to have other contractors bid on the work cited in the inspection report. Then, another MOTION passed to have the attorney render an opinion regarding responsibility for the reattachment of the garden windows. Also, there was discussion again about sending some sort of notice to owners regarding the inspections. (Note: Such a notice (now a questionnaire) was prepared to accompany the mailing of these minutes.)

Everyone is encouraged to attend the Annual Meeting at 10am Saturday April 21st in the Sizzler Restaurant, 2855 Midway Drive, to discuss the garden window reattachment issues, such as which units are affected and who will pay for reattachment.

2) Work Authorizations #769 through #778 were discussed. Most were a result of vandalism, such as #773 to replace the vandalized mirrors in the B-Building's elevator with blue paneling, #775 for fence repair by A-108, and #777 for a damaged lock on the door near the pool.

New Business:
1) Carpet Cleaning. The previous contract expired in January. Coit Carpet Cleaning, the contractor the HOA had been using whose work caused several complaints, and the Carpet Club had both submitted bids. After relatively brief discussion, the Carpet Club's one year bid for $2100 was accepted by MOTION.
2) Beverly Powers Resigned. At the end of the meeting, Beverly Powers, currently President, handed out her resignation statement. Ms. Powers moved here in 1982, and had been on the Board since 1989. Other Board members expressed their appreciation for her twelve years of work on the Board of Directors, and asked if she could delay the resignation. But, she said she's moving and her condo is for sale.

Adjournment to Executive Session. The meeting was adjourned to Executive Session about 8:00pm. During Executive Session three monetary penalty cases were considered, two for condos with large dogs, and one for smoking in the hallways. The two dog cases were dismissed after evidence was presented that there was no violation of the rule about pets. A suspended monetary penalty was approved by MOTION in the case of smoking in the halls.

NOTE: The next meeting was changed to Monday March 26th in B-205. Upcoming meetings are Saturday April 21st at 10am in Sizzler Restaurant, 2855 Midway Drive, for the Annual Meeting, then on Thursday May 24th 7pm in B-205, and Thursday June 21st in B-205.
