Amend CC&Rs

I would like to discuss what we the homeowners want the board to do for us.

I do want the board to everything it is doing now. I think it is important to keep the community it great shape. I also feel that the board should take strides in finding out what the homeowners want in the CC&Rs.

When I first bought my home I only had one concern and it was the association. I did not want uptight people telling me how to live. I Recently read Mark's View in our news letter which prompts me to respond.

I am not concerned with people parking in the street. I do not see any problem with this. Is it hazardous? It could be if a child is not being supervised by its parents.

In our CC&Rs I read (a long time ago) that basketball goals were not allowed. But yet I see a few homes on my block have them. Do I mind? No! Is there anything being done about it? I would say no.
Most of the homes on my block have a ton of weeds in their yard. Do I mind? Yes! Is there anything being done about it? I would say no.

My point is that we need to amend our CC&R's to reflect what our homeowners want. They should not be subjectively enforced by a few people.

Lets get the communication flowing and make this the best and happiest community there is.

I wanted to wait a few days to see how many people might reply to the message. Unfortunately, nobody did.

Thanks for letting us know your concerns, Amamda, it's why we have this site. I'm not really sure how you would like to see the CC&R's amended, though.

You seem to feel that parking on the street isn't a major problem, but it's a violation of the CC&R's and it's up to City Property Management and the board to enforce the CC&R's. We aren't going to pick and choose which violations we deem as ''serious''. Every homeowner signed for the same CC&R's which means every homeowner is expected to abide by them.

It's too bad some don't feel the need to, or the importance of adhering to the CC&R's. Don't think for one second, though, that people aren't getting violation letters for weeds, basketball goals, inop cars, street parking, etc. Every month we receive a huge stack of the violator's summary information. Whether the violator's choose to correct the violation is something we can't immediately determine. Some do, some don't. The one's that refuse to correct the violations will be fined and the process continues.

You never read (or you read incorrectly) that basketball goals were not allowed. Portable goals were permitted as long as they were stored out of sight when not in use. We know that some of the CC&R's are written vaguely and are open for interpretation, but we still expect all residents to abide by them.

Please provide further feedback on how you feel the amending of our CC&R's will enhance our neighborhood, I'd be interested in hearing your ideas.

Remember, as a board, we don't want to be so strict that it seems we're not allowing each resident to express they're own style. But a yard full of weeds does not make a stylish home. A homeowner being non-complient doesn't necessarily mean that nothing's being done, it means he/she/they don't respect what it means to have a decent neighborhood to live in. We all have to set the example.

CC&R's finally getting attention

I also would like to know what Amanda would like to change in the CC&R's. The fact that they are vauge is good. You hear so often people complaining about how strict their HOA is, but I think our group is doing a pretty good job. The CC&R's cover just about everything and some of it is, I'm sure, just there to keep out excessive behavior and set standards to be used with common sense. So I don't think we need to re-write anything (though I would like to see something ADDED with respect to kids playing in streets...I think all these houses have back yards, right?) I just think there needs to be a little more enforcement of the rules that really bother people (like weed control) and the rules that are safety issues (like cars parked in the street).

I would have to assume that Dave does not have children. Yes we do have backyards, and my children spend a great deal of time playing in the backyard. But, have you ever tried riding a bike, a scooter, or flying a kite in a standard size backyard. We were not finacially able to by a larger backyard, and the location of our home does not make the green belt an option all the time, without taking a cooler of cold drinks. The children also have friends that live on the street, and this way all the kids can play together. There is always a parent out with the children, and 99% of the time, they are in a driveway or on the sidewalk. If they do go in the street, as soon as we even think we hear a car they all move to the sidewalk. My concern is the speeders that go through this neighborhood. Most of these people, if they see children aren't even watching to make sure they are not near them, they just want to get where they are going as quickly as possible. I have tried to get the city to put up signs that say ''Slow children at play'', but was told they are illegal. Surely something can be done.
