In the process of pressing a zoning appeal matter of four unrelated people living in an R-1 zone,WUCA uncovered a proposed "Room & Board" permit by the plaintiffs. Subsequently, inquireies of other persons who might reveal knowledge of such permits led us to the Denver Code, which listed Room & Board as one of 13 home occupations.
A meeting was arranged through Councilwoman Kathleen MacKenzie's office to confer with Charles Meredith, Senior Zoning Specialist with Denver Community Planning and Development.
Meredith was clear and forthcoming in pointing out two things: (1)Rooming and/or Boarding is allowed in R-1, R-2, R-2A, R-2N, and the six Mixed Use zoning designations. (2)A total of three occupants is the limit, and in ALL instances no more than three UNRELATED residents are allowed and in ALL instances, a Rooming and/or Boarding permit MUST be applied for and purchased ($20 fee) prior to occupancy. The application must have all names of occupants listed (one applicant and a maximum two boarders). Only a renter may be granted the permit, not an absentee home owner. Also, if any of the three were to move out, a new permit must be applied for.
IF A RESIDENCE IS SUSPECTED OF A PROBABLE VIOLATION of the Denver Code in this regard, a call to Meredith at 720-865-2986 will initiate an investigation to determine the authenticity of the occupancy.
