Deed Restrictions

I just wanted to add that I did not sign a paper that stated what the deed restrictions were nor did I get a copy of the deed restrictions from the builder nor at the time of settlement. However, during the building process it was communicated verbally that the community would be deed restricted but I did not receive a copy of them. When the deed restrictions were posted to this website that was the first time that I had seen them. The ones on the website are not even signed or dated. So how do you know if they are the legal documents that were submitted to the county? I recently called the law firm who handled my settlement and inquired about not receiving a copy from the builder nor the law firm. I was told that they did not give them out at the time of settlement because the builder was suppose to do that. If you are one that did get a copy from the builder then you were at an advantage, if they were signged and dated. The law firm did send me a copy of the signed and dated deed restrictions. The ones that are posted on this website are not signed or date and may or may not of been accurate or the ones that were filed with the county. Do you have a copy of the bylaws and the Maintenance Declarations? If you do not then you can request them from either the board or from the county. If you do then read them and in those documents you will read that the deed restrictions can be modified and should be reviewed periodically to see if any changes need to be made as the community ages and as times change. Opinions are fine but when you state that we all signed the deed restrictions and new what we were moving into, that is telling me that you are not open for change and that you have nothing you would like to see changed in our community. And there is nothing you would like to change or add to your home or property that would increase the value to your home as well as the community or potentially make your life a little easier. Ask you self if there is anything you would like to see changed. Or is there any thing you would like to change or add to your home or property that may add value to your home as well as the community and maybe adding a little privacy or keeping you family safe? If you answer this question, I am sure you could come up with something you would like changed as well and changing or adding to your home and property. If you don't have an answer and don't want any changes then I guess as your home and property ages you will benefit from the ones that do. If you were to sell. The one thing to remember is that if you were to sell your home and there are other houses that are also for sale, what house do you think would sell? The one that is the original home or the one that has made changes and added value? So when you state that we knew what kind of community we were moving into and that the deed restrictions are what they are, make sure you remember that if you were to make a change to your home or property that you are not able to make due to the deed restrictions. You knew what kind of community you were moving into. I take pride in my home and community. Changes are necessary just like deed restrictions are. But, they need to suit the community and ours do not. Dan, I think if you want a change regarding the fences I am sure you are not alone. Send your proposal for the change to the board so that they can add it to the list of suggested deed restriction changes that will be communicated at the next community meeting.

As for oinions, we all have them, and we need to watch how we relay those opinions so that they are not offensive or attacking.

Deed Restrictions

Sharee-
Please don't take it as an attack, that was not my intent. I was just trying to explain that you didn't seem to address whether or not you agreed with Dan, but made his question seem unimportant. My intent was not to get you upset or to disrespect you, that is not the way I am. My post was just was stating that Dan was asking a simple question and wanted to get some opinions from the community whether they also felt the same way. I would hope that you start a thread to discuss the issues that concern you. It will give the community the chance to voice their opinion on those issues.

Thanks, alicia
