Minutes for June 10, 2004

Jun 18, 2004

Present: Tim Hardy, Carol Kidd, Linda Duncan, Charles Owen, Bob Davison, Mark Osborn, Vicki Welch, Steve Montgomery (alt. for Jimmy Hickey)

Absent: Dennis Hamilton, Jimmy Hickey

Guests: Al Church, Matt Welch, Jan Hardy

The Minutes for May were read and approved. The Treasurer's Report as of May 24 showed a bank balance of $50,043.23, all but 16 homeowners now having paid dues. Jimmy was not here to tell us about the street-cleaning date of service.

Al Church began our meeting by reporting that his home is being targeted by vandals. His home has been egged, a window shot with a pellet gun, plants destroyed, and more. Others have also reported eggings and more. He did notify police, and he urged us to make everyone aware, which we intend to do in a special edition of our newsletter. We also will be attending the District 13 Community Meeting on June 15 at the Firefighter's Union Hall where we can share these problems with the police.

Old Business:

Streetlights - Tim reports that he will be given the schedule for lightpole additions as soon as LG&E's reps return from vacaton. We are still waiting for 30 new poles.

Fencing along the back lake - Tim and Carol met with one of the five fence companies they contacted about fencing for the back lake. They report 3 options available: replace 9 posts and use wooden rails - $1500; replace 9 posts and use woven wire on existing good posts - $1550; replace 9 posts and use farm fence - $1200. Replacing the fence on the north side of the back lake would run an additional $1300 - $1600. It was agreed that Tim and Carol would talk to the other companies to see what their offers might be and report their findings at the July 6 meeting.
^* Dennis will be checking on the cost of staining/painting/treating the split-rail fence around the front lake. We may have to do a 200' section per year in order to be able to afford fencing up-keep.

Salvage yard proposal - Matt Welch reports that the proposal for Pull-a-Part to get a conditional use permit from BOZA is not on the docket at least through August. If BOZA grants Pull-a-Part this permit, we can appeal the decision to Circuit Court, but we will need a zoning lawyer who can help come up with good reasons not to accept the salvage yard. Tim brought information from a zoning lawyer (Seiller and Handmaker) telling us we may need to join with other affected parties (Senior House, Yorktown South, other salvage yards) and talk to an attorney not only about appealing BOZA but also about getting the site changed from an M3 to an M1 classification. Directors will be attending the Community Meeting June 15 to let Ron Weston know our concerns and our intentions if BOZA approves this. We plan to invite Ron to our next meeting - July 6.

Sprinklers - Bob and Charles have contacted Evergreen Irrigation, who got all but one of the ten zones working at the Sam entrance. However, the Highway Department will be digging here again...our irrigation system is sitting in the right-of-way. For now, Bob wil check out getting a hose tapped into the fire hydrant to irrigate the zone on the south side of the Sam island. We will be told when digging is to begin again on Sam. Nothing at the Old Towne entrance will be bothered when digging begins again.
**Tim will see about getting the lights repaired on the wall at the Sam entrance.

Publishing names of homeowners owing dues - Vicki reports that there is nothing unlawful about publishing in our newsletter the names of those owing dues.

Sidewalk into lake - Linda talked with Jill Allen and Dave Shaftleim of MSD, and they tell us that work on parts of the lake, including the fallen-in inlets, will begin this fall. Dave wants to look at that Old Towne sidewalk section again.

Trees on the lake - Linda reports that Matt Nally of Operation Brightside can get 4 types of trees (Sunset Red Maple, Golden Willow, River Birch, Shawnee Brave Cypress/ another type Cypress)
10' - 12' in size, guaranteed for one year, and with gator bags attached for water (worth $19.95 a piece), 12-15 of them for $2,400. Planting can begin in late August or September. Linda will check with Ken Mulch to see if they can do better.

Tim also reports that state-merited memorial plaques with certificates of dedication can be purchased for $55 so that residents may buy a tree and memory plaque for $250. Residents will be given an opportunity to purchase these via our newsletter coming out June 13. Vicki will be the contact person for the memory trees.

New Business:

Vandalism - Eggings, pellet gunshots, rocks being thrown through windows, signs and posts being painted, etc. are being reported from around the neighborhood. Our newsletter will contain an alert message for residents. Police are involved.

Safe Deposit box - Charles has seen to it that our box will not be charged for this year since the bank had advertised that moving it warranted free rental for one year, and they did move it to New Cut.

Newsletter - Vicki will prepare this for distribution on the weekend of June 12. This will contain information about the vandalism, the memory tree offer, notice of the June 15 Community Meeting for District 13 where residents can meet with Ron Weston concerning their feelings about the proposed salvage yard across from Yorktown North and other concerns.

Adjourned: 9:15 p.m.
Next meeting: July 6 - 7:00 p.m. - Bearno's
* modified date so Ron Weston can attend
