Still Need That Section of ORC

Ms. White, I still would like to know exactly which section of the Ohio Revised Code you are referring too.

Who Did What

Ohio Public Works did send a letter. It stated that money from current projects could not be used to pay to fix prior projects. That is all the letter said. It did not say that the Village did that, just that it could not be done. If the Village had done as you alleged then why did the OPWC not pursue the matter and get their money back? There was nothing for me or the Council to do. It would seem that the ball was in the court of OPWC to pursue the matter and recover any overpayments if something was done illegally. Other than writing a letter they took no further action. If something had been done illegally why then did OPWC not do anything? I can only guess that there was nothing illegal.
Why Did They Not?

That is a good question.

I took the information to OPWC showing that Russolillo and Brad Smith submitted fraudulent plans to MORPC. They put in alternates without specifing what they were. I went to Bale, who did Phase V. They told me what the alternates were. MORPC and OPWC said that they thought the alternates were in the scope of the current project. Hence, double payments for Pomeroy, to pay for screw ups n previous jobs they had already been paid for. Instead of making Pomeroy correct the mistakes, they were put in as alternates on the next project.

Why do you think OPWC sent the letter? Why do you think Russolillo and Smith were so scared they went to OPWC and asked what I had been told? As to why they didn't do anything, you will have to ask them.

Why did the residents have to pay $26,000 for the alley behind your house? Because it was slipped in and was not in the scope of that project. Why do you think $10,000 was taken away in Phase V, which was Elliott. Because the money was to pay for the problem at Westfall's, that was Phase IV. Then, Russolillo said that it was already in the contract with Pomeroy and they would sue, so the Village paid the second time.

Paul, you are a smart man, why is this so hard for you to understand?

If someone does a job at your house and it is wrong, do you pay them again to correct it? Of course not!

Get from the Auditor

The information was given to all of council about how to request an increase in fines. I don't know if I still have mine. I'll check.
