In our deedd restriction there is no place that says you can fine anybody. In there deed restriction they might have an article or section that says that your allowed to fine them, we dont. End of story. You cant put fines in our deed restriction without 2/3 majority and that will never happen. You can put all the example you want on here, but nothing can change until you get 2/3 votes to changed it.
And like you said when and if a committee is formed, that is a big IF.......

Tell me what your deed restrictions say? Then tell my why you don't follow them? Then tell me as a HOA, why we need 2/3 vote to enforce the restrictions as the stand.
What makes you so sure this won't happen. The move is on. Their ( not there )deed restriction: Article V section 2 of mine ( most importantly the sentence that says '' may take whatever action''. This also talks about liens and interest on the cost.
Read it and weep.
Again it is the people who live here that don't care about other people need to understand that we will not let this happen.
As I read my deed ( not deedd ) restrictions they are simple and easy to follow.
I think the big if is it will happen.
So what will you do if it does?

If the deed retriction are so easy to follow why hasnt any of the trustee past, present or future will enforce them. I agree you can put liens on the house but you can not find them, like you are trying to say. That is my point you cant fine anybody.

How can you put a lien on the house without first a fine? Please read the website hoatalk.com It gives plenty of examples of process. One more time I will say we can implement a process even if we need to get 2/3 of the people here to vote for it. I think the wording in our deeds would allow it without a vote. Homeowners here could vote by proxy, or come to a meeting, and I am going to make sure this happens. Look to your left and look to your right. I think 2/3 of the people here do what they need to do when it comes to making sure they have an attractive home. It is just you few who become the parasites that will suck the value of our homes away.
I don't think I have a simple mind. I do my research. I would like you to tell me what your deed restrictions say when it comes to your property.
