Non-conforming pets Exception
The last draft of the new HPT Rules which were distributed to homeowners prior to Board approval and legal input (they still haven't been finalized and distributed to all residents) provided a grandfather clause for all existing non-conforming pets as of 12/31/01. In other words, anyone who as violating the CC&R's as of that date have been given a free pass by the Board. The Board did discuss a particular non-conforming dog whose owner had been notified in writing by Randy that he had 30 days to get rid of the dog or move-out (renter). A discussion of this particular dog ensued, but I know the Board did not take any action on this item in a public session. This was prior to the new rules and since I have since seen the dog in question in the building, I suspect the eviction was cancelled (possibly in Executive Session). Personally I do not believe that the Board has the authority to grant exceptions to the pet policy which is defined in the CC&R's. |
