Make Kachina Do Their Job

Kachina CAN enter a property to take care of weeds, unapproved structures and Junked cars. Call Brett Lang at 623-572-7579 and make him do his job!

From the CC&R's:

Section 4.3 Nuisances; Construction Debris

No rubbish or debris of any kind shall be placed or permitted to accumulate on any Lot or Parcel, and no odors or loud noises shall be permitted to arise or emit therefrom, so as to render any such property or any portion thereof, or activity thereon, unsanitary, unsightly, offensive or detrimental to any other property in the vicinity thereof, or to the Residents of such other property. ?…No condition shall be permitted to exist or operate upon any Lot or parcel so as to be offensive or detrimental to any other property in the vicinity thereof or to its Residents.

Section 4.12 Vehicles and Parking

No motor vehicle shall be constructed, reconstructed or repaired on any Lot in such a manner as to be Visible From Neighboring Property, and no inoperable Motor Vehicle may be stored or parked on any Lot in such a manner as to be Visible From Neighboring Property.

Enforcement - How To for Kachina

Here is HOW they can fix it:

Article II ?– Section 11.1 Enforcement

The Association may enforce the Community Documents in any manner provided for in the Community Documents or by law or in equity, including, but not limited to:

(f) requiring an Owner, at the Owners expense?…to restore the Lot or Parcel to it?’s previous condition and, upon failure of the Owner to do so, the Board or it?’s designee shall have the right to enter the property, remove the violation and restore the property to substantially the same condition as previously existed and any such action shall not be deemed a trespass;

(h) towing vehicles which are parked in violation of this Declaration or the Association Rules


So don't let anybody else tell you otherwise. Kachina needs to get some guts and put a little teeth in to their enforcement.

Michael - maybe instead of a new garbage company we need a new Management company. Please forward this info to the other board members, as I am sure Brett Lang won't bring it to anyone's attention. It is easier to just cash our checks and let the weeds grow, and the old oil flow.

Kachina Sucks!

I think it's VERY obvious that Kachina knows nothing about community management. There are so many companies out there, I don't know WHY we're stuck with this no-name that works out of his house. kachina@juno.com??? What professional organization uses a generic email like that, are they to cheap to buy a godaddy domain for $10 to not look like fools? I guess not!
Kachina Not doing there job

Hey Michael,
Let me paste this reply from you about several houseson E.Camden ave, specifically house # 3630 the Drysdales.
They have had a weed problem for a year now and house 3555 has only dirt and weeds on there front. Seems to me we do need another mgmt co. It is clear as day in the ccr's that you are wrong. SEE BELOW!!

Ok....I will verify these two addreses with my delinquent reports. If there is a history of fines for the same reason, the HOA has the ability to significantly raise the fines for the same violation. The board members cannot legally discuss any account with the members of the community (privacy reasons), but I will investigate these two addreses. Legally we cannot go onto the property without the owners permission, that would be trespassing. And unfortuneatly, we cannot file a lien based on fines. I know you don't want to hear it, but all we can do is continue to fine a repeat violator. I will also look into what further action, if any, can legally be taken.
