TP Whoever wrote the article in your link is an idiot. There is nothing in the bill of rights or constitution that applies to a guarantee of equal protection by private institutions relative to health care. The bill of rights and constitution only protect us against infringements of our inalienable rights by the government. And those inalienable rights are spelled out in the bill of rights and constitution. The idea that the constitution is a "living document" is certainly not a settled concept by law. The constitution may be construed to define our right to pursue health care by all means at our individual disposal, but it does not guarantee "outcome". There is also nothing in the constitution that gives the state the right to force us to buy or not buy health insurance. I'll bet you any amount of money that any provision along those lines will not stand up in court in the final analysis. You name the figure you want to bet and we'll find a way to do it! |
