My letter to Kachina

RE: Castlegate homes out of compliance
Dear Mr. Lang:
Please note the following homes, and their issues. I am not sure how often you visit our neighborhood, but the conditions of these homes have gone overlooked for too long, and it is affecting the quality and safety of our neighborhood:
4514 E Rousay Drive ?– This rental property was abandoned 4 months ago. The tenants left behind a broken basketball hoop, a house full of garbage, a front yard full of weeds and dead plants, a backyard full of debris, and an unlicensed, inoperable van.
The van has become a target for vandalism, and is played on and in by local children. It has four flat tires, expired plates, and is leaking a pool of oil.
The home was left full of trash and food, and four months?’ later smells awful and is attracting pests.
The home and property are in violation of the following portion of the CC&R?’s, and it is the obligation of Kachina Management to take immediate action to enforce the CC&R?’s and resolve the issues:
Section 4.3 Nuisances; Construction Debris
No rubbish or debris of any kind shall be placed or permitted to accumulate on any Lot or Parcel, and no odors or loud noises shall be permitted to arise or emit therefrom, so as to render any such property or any portion thereof, or activity thereon, unsanitary, unsightly, offensive or detrimental to any other property in the vicinity thereof, or to the Residents of such other property. ?…No condition shall be permitted to exist or operate upon any Lot or parcel so as to be offensive or detrimental to any other property in the vicinity thereof or to its Residents.
Section 4.12 Vehicles and Parking
No motor vehicle shall be constructed, reconstructed or repaired on any Lot in such a manner as to be Visible From Neighboring Property, and no inoperable Motor Vehicle may be stored or parked on any Lot in such a manner as to be Visible From Neighboring Property.
Resolution:
Article II ?– Section 11.1 Enforcement
The Association may enforce the Community Documents in any manner provided for in the Community Documents or by law or in equity, including, but not limited to:
(f) requiring an Owner, at the Owners expense?…to restore the Lot or Parcel to it?’s previous condition and, upon failure of the Owner to do so, the Board or it?’s designee shall have the right to enter the property, remove the violation and restore the property to substantially the same condition as previously existed and any such action shall not be deemed a trespass;
(h) towing vehicles which are parked in violation of this Declaration or the Association Rules
Mr. Lang, we are asking that you resolve these issues immediately. Most notably would be the abandoned vehicles. A copy of this letter is going to all Home Owners on East Rousay Drive in order to help maximize it?’s effectiveness, and to help assure everyone has your correct contact information.
