Good news! We have finally reached a settlement on the issue of the ditch. The ditch will be brought into a condition that will lift any violations imposed by the city. The developer will be in control of all work performed and we should see the start of the work with the next 30 days. At the completion of the work it will then be inspected by the city to ensure that the work is sufficient to remove all violations. Further information will be distributed soon in our newletter that will start to go out quarterly.

The settlement is written that the city will have to approve all aspects of the work. Our lawsuit will be lifted only apon all of the work being finished and fully inspected by the city and signed off as being in compliance according to the original plan for the ditch. Of course, this will not be the envisioned idea of what we would like the ditch to look like I am sure. This is why we are waiting until the work is finished and signed by the city to invoice the 400.00, so that we can see what we will need to do to continue the improvements. All of the work being done up until the city signs will be at the expense of the Developer except a small capped amount being paid by the Association for the removal of the debris. This settlement was the most cost effective way to reach our goal of having the ditch work completed. This will allow us to move forward as there are many improvements that need attention. We are all anxiously awaiting the sign of workers in the ditch. Hopefully the rain will let up so that they can begin. |
