Members,

 

As summer begins to wind down, your Association Board of Directors must begin

preparing the budget for next year, which includes setting the annual dues and
road maintenance fees, and determining the billing cycle and payment options
for 2012.

 

Members of the Board are keenly aware of the ongoing housing and financial  problems facing our country and the devastating impact on some members of our
Association. Last year was a very difficult year as evidenced by five bankruptcy filings, six foreclosures and one deed in lieu of foreclosure in our little community.

 

No one on the Board enjoys issuing past due billing notices, intents to lien, or filing liens. Board members are not without sympathy, however are compelled by law to fulfill their fiduciary responsibilities to the entire membership – which includes collecting assessments and taking enforcement actions as necessary for the benefit of the entire Association.

       

With all this in mind the Board is considering the following:

 

1)       2012 dues and fees should remain frozen at 2011 levels.

 

2)       Assessment invoices will be issued 12/01/2011, due 30 days later, followed by a 30 day past due notice (if needed), and then a 30 day final notice (if needed.) This lengthens the billing cycle by 30 days.

 

3)       The $10 late fee will not be assessed until the final notice is issued.

 

4)       The state mandated 45 day notice of intent to lien will be issued with the final notice.

 

5)       The Association Treasurer will work with members who require installment plans to pay their assessments. These payment plans will be done on a case by case basis.

 

The Board wants to make every effort to ensure our members are able to pay their annual assessments. When you receive your invoice in December, please be sure to contact the Association Treasurer if you need to make installment payments. The Treasurer has been instructed to be as flexible as possible in developing these payment plans to accommodate each individual member’s situation.

Note: As per Florida statute,  payments will be applied in the following order: interest accrued, late fees, costs and reasonable attorney fees (if applicable), delinquent assessments, and current assessments.
