I am in favor of taking a vote at the next annual homeowner meeting in February to amend the By Laws to place a limit on the amount of money the Board can spend, without a 2/3 majority vote of the homeowners. Necessary maintenance and repairs would be excluded from a required vote. At this time the Board has no limit on their spending and can spend association money at will. I am interested in your opinion.

Linda, In concept, I agree with you. However, I believe if our board representatives would make an effort to engauge their neighborhood constituents, they would have a better grasp on the community pulse prior to the decisions they make. To date, I have never been approached by my block representative regarding a topic or issue that was proposed at the board level. Show me the data that supports the latest changes to the front gate; How many cars per hours use the exit side of the entrance; How many accidents have occured per month due to the current arrangement; What alternatives were considered prior to the decision to change the curbing.(1)Reverse the gate (2)Spiked road bumps (3)Warning signs. I recognize that these board positions are all filled by volunteers as I currently hold postions on two committees myself. However, purely having the seat in those committes does not allow me the autonomy to make decisions without input from the community at large when appropiate. |

Idea not feasible
Linda?’s proposal to require a two-thirds vote of homeowners before the board could authorize any expenditure other than necessary maintenance and repairs is not feasible or workable. The residents elect the board (who are all unpaid volunteers), and the board manages the affairs of the association on behalf of the residents. It would be an unreasonable burden on the board if they had to take a poll of the residents each time the board felt an expenditure was required to be made. Linda is incorrect when she states that there is no limit on the amount of spending the board can authorize, or that the board can spend association funds at will. Our governing documents require that the board exercise ordinary business judgment in managing the affairs of the association. The board is required to act in good faith and to take actions they reasonably believe to be in the best interest of the association. In addition, our governing documents place a limit on the amount of dues that can be assessed each year (the current dues level are well below such specified maximum), thereby placing a finite limit on what the board can spend. Also, the board acts by majority vote, so no single individual board member has the authority to approve an expenditure.
