Sorry that did not come outright. Was on my phone posting. This would make the President of the hoa responsible for making all infractions of the covenants up to date. He is the chief executive board member so he is the one that would be sued. The HOA if they lose would be responsible for any attorney fees as a result of this. Or basically the HOA President would be.
Who are they to decide what brings down property values. The infractions they are pointing out are subjective to their interpretation. Based on what? I think all the wooden privacy fences have brought down our values more than anything else. Especially lettering on a mail box. What I am suggesting is to sue them for not enforcing all covenants. Who are they to pick and choose. Is it who do we like and who do we not? This easily changes with the change of board members.
Better yet, mind your own business. The pole on my box has been the way it is for ten years. It has not been a problem in that amount of time. It is not a problem now...
