The board of directors has contracted Andyman Services of Fraser to sweep the fireplace chimneys throughout the complex. The cost is $35.00 per unit and will be paid from the association?’s maintenance reserve. It is unclear when the chimneys were last cleaned, and the board of directors is concerned about the potential fire hazard resulting from combustible build up in the individual flues. Chimneys are external to the individual units, therefore the responsibility of the HOA. Chimney cleaning, therefore, is the responsibility of the HOA.
The fireplaces are part of the individual units, therefore the responsibility of the owner. One of the unfortunate byproducts of chimney sweeping is the amount of discharge from the chimney into the fireplace. The amount will depend on the cleanliness of the individual flue.
In order to reduce the amount of residue in each unit, the chimney sweep needs access to the housing unit to mask the fireplace and to clean the discharge from the fireplace when he is done. This is part of his task.
If an owner chooses not to allow entry to the unit for dust prevention and discharge removal, that owner bears the responsibility of cleaning the resulting filth.
