Hi. All of the information provide by Mrs. Jablonksi is correct. Please note she was approved for a pool fence and this where past boards have allowed fences other then wood split rail. I cannot speak to the reasoning, but it clearly states in the deed restrictions that all fences are to be constructed of wood split rail. With that being said, the previos board should have never approved this fence. I only bring this up because, this is the only time past boards have strayed from guidelines when it concerned a pool fence. I know this, we spoke at lenght about this very issue when I was elected to the board. If the fence was just for your yard, they have stayed strictly to the guideline that it be a wood split rail fence. So I don't know where we go from here, but we would be happy to speak to you. Please keep this in mind, if we make exceptions for this rule, what is going to stop other homeowners for asking for exceptions to other rules. It might be a rule that you are in complete agreement with, but they are not. Just something to think about. This is exactly why we need better turn out at the meetings and during voting. If more people voted this fence rule could have been changed.

But can I just ask why putting in a vinyl fence we be such an issue. I am fully aware that the deed restrictions specifically state that it has to be a wood fence, but what harm would it do if it were vinyl?  I understand that other people would want that as well, but as long as its not harming others or impeding in property value, why can't we put it in?

I think I am just disappointed.  I did vote to have the restriction changed, we pay our dues on time, and are pretty great neighbors (in my opnion) so it's just hard to swallow that we can not add the fence that we want to our property and are going to be on some level forced to put in and pay for a fence that we don't like.

That means we all can have vinyl. I have talked to my closing attorney about this.  It was allowed. This means everyone can have it now!  The board should have made better decisions in the past. My closing attorney has advised me that it wouldn't stand up in court if you cited other homes.  That was approved. That means anyone can have it. They should be made to take it down.  It is clearly written in the deed restrictions!

I was also disappointed. I really thought we would have a better turn out. We have a board meeting in few weeks, I will bring this up at the meeting. I will bring up the point that neighbor07 posted as well. If you could contact us via email, I can make sure we get back to you directly. The last thing this board wants to do is hurt anyone. We are open to change, but we need the help of the community to make changes happen. Vote, vote, vote... My time is almost up here, I will be moving in a few weeks. Sylvia will become President.
